Woman shoots as robbers flee.

Obviously the immediate threat was not over as they turned and fired at her.

We need our fleeing forcible felon statutes back. If you threaten someone with a gun; you should be shot. You shouldn’t get a pass because you turned to run and got shot in the back.

I agree 100%. I was just wondering how a court would view it if she had killed one of them.

I know what "is right" with most of us, but the imminent threat had left/retreated and as I understand the story gunplay wasn't involved until the victim pulled a gun after-the-fact.  It was no longer self-defense but a retaliatory act by the victim.  Just sayin' it makes for a weak self-defense scenario.   Will come down to the DA.  If the bad guy had been shot a substantial distance from the victims, may be expensive to be found not guilty.  Again, not sayin' it is right, just the way the legal system can spin.

If she had chased them down, then yes maybe I could see the threat being gone.  But since they were armed, taking for granted they used the gun in the robbery, then the threat was not over IMHO.  Things can go south in a hurry, and seeing the bullet hole in the car, they were still in range; so again, I wish she was a better shot.

Assuming..........they were armed.  I am assuming they didn't present the gun until they were shot at by victim.  Either changes the position.  Maybe simply a drug deal gone bad.  Maybe bad guys shot back in self defense.  Details. Details

Legally she's on some shaky ground and might be at the mercy of the DA's office.  Legality aside, it's also worth considering the probability of actually getting a hit on a moving target as they withdraw, and weigh it against the lack of danger in the immediate moment.  Goes back to knowing your target and what is beyond.
