Hand Gun for Christmas??

Is it LEGAL to buy a hand gun in TN for a family member who live's in another state and is well over 21???

Nope. Legally, if you bought it here in TN it would need to be 'transferred' to an FFL in that family members home state.

The handgun in question will also need to meet said states gun laws.

To do anything else would be considered a "straw purchase". I myself bought a pistol and have a brother in Ga that absolutely fell in LOVE with it. I mailed it to his gunshop and let him pick it up. That is absolutely legal.

any other way, its not. but I don't think it can be considered a straw purchase if it was bought with the intention of giving it as a gift. I could be wrong though.

it is legal to buy as a gift, as long as the person you are buying for is legally able to own a handgun.

straw purchase is when you buy for someone else to bypass the system.

Yes you can buy as a gift providing:

1. They are legal to own or have bought it themselves etc, etc.

2. It is transfered to a dealer of his state. You don't have to ship it. You can jsut go to the FFL, have them record it and then transfer it.

What if you buy it as a gift for someone legal to own it in this state that lives here? Does anything need to be done? Are you supposed to write anything different on the form when you are filling it out. I know it says if you aren't the person... Well, I don't remeber the exact words but the gist is if it ain't for you are breaking the law . Anything different if it's the same household?

No you are good to go. IMO you are buying it for yourself for your own purposes. Whether that purpose it to carry, shoot, compete, or gift it is all the same. Again i'm no lawyer, but I wouldn't worry to much about that scenario.

Yes, that would be great, I would like either a Berretta 92fs in 9mm, XDm in 9mm, or a 1911 of mid to high quality. RIA will be ok.

.. and to add. If you do do this and end up shipping it to an FFL... make sure that that FFL takes transfers from non FFL holders.

There is a provision on the 4473 that allows you to purchase as a gift. Also since there is no paperwork required for face-to-face sales in TN, you can basically just think of it that way.

A straw purchase is when you buy a firearm for another person who you know could not legally purchase one themselves.
