Do you have to have a "Gun Trust" in place to own a SBR or a suppressor? I know all about the tax stamp, But I'm not clear on the gun trust. If I'm the only one transporting or using the firearm, Do I have to have a trust in place?

No you don't have to have a trust, but a trust does have several advantages such as the ability for multiple users and estate planning. It also helped bypass some other hoops to jump through but the powers that be changed that starting today.

Thanks guys, that's what I thought. My son is in the process of setting up his and wanted to get it done before todays law change {He is on deployment with the navy}, But the D-I-L dropped the ball and didn't get me the paperwork till yesterday even though she has had it since 6-1. He will still get it set up, just have to jump through more hoops

I think you also need to take "access to" into account, not just use and transportation. If you are the only user of, say, a suppressor, you have to store it such that no other person has access to it. So if your only safe is accessed by you and your significant other, you might be in violation of the law. A trust that includes you and your significant other, will get around that issue. Even if she doesn't use it, she can now legally have access to it, in other words, access to the same safe.

That's at least my interpretation and the reason I chose a trust. While my wife won't be shooting my SBR or suppressor, she does have access to the safe in which they are stored. In my opinion, it also makes it easier to handle the NFA items in case of my death, for handover to my beneficiary for example.

This is exactly why I will be forming a trust....

I was referred to John Wells in Brentwood to set up a trust.  He answered all my questions and had it completed in a very short time.

A trust is probably the best way to do anything NFA related when it comes to those in the military.  It gives the legal flexibility needed for things like deployments, and permanent change of station orders to non NFA friendly states.  If your son is still a Tennessee resident, I'd highly recommend reaching out to one of the trust lawyers on our site.

John Well's set up my trust, too. Good guy, can certainly recommend him.
