DUI & HCP??

Recommended Posts

I know this has been discussed in-depth before, but my search returns no results.

If a person has a single DUI conviction, do they have to wait a certain time before being allowed an HCP? Someone I know seems to think the law has changed on this.

The only one I know of is in 39-17-1351. One conviction is not disqualifying. I know of no recent changes.

It's not stated on TNDOS and I've never seen anyone confirm it one way or the other, but hard to believe they'd issue one till after if your conviction sentence was done (typically 11/29 jail/probation for the Class A Misdemeanor) since an existing permit is suspended for the same. But then again, that's not directly addressed in TCA and it's not an exact question on the HCP app either, so maybe it's just an ironic loophole for a new applicant.

Which is not to definitely answer your question. Why dontcha ask Lisa (and only Lisa) at TNDOS and share here?
