What if official policy forbid that? Would it worth losing your house and your families security to eat and live indoors?

What if the officer just woke him up and allowed him to call a friend to come and get him. Would the LEO still violate protocol?

What if official policy forbid that? Would it worth losing your house and your families security to eat and live indoors?

What if the LEO just woke him up and allowed him to call a friend to come and get him like the did in the times when I was growing up? Would the LEO be violating protcol call then also?

Yes, on my department you would be in violation of department policy and subject to punitive action including dismissal. The liability is too great if the guy has his friend drive him around until you leave and then takes him back to his car. He drives and gets in a wreck. You think his attorney isn’t going to say a cop had him and didn’t think he was drunk enough to arrest. Well certainly he will and he will try to put the liability on the cop.

Look at post #15; a cop was fired. There is no defense.

Should a cop have discretion? Absolutely, but in DUI and Domestic violence cases most departments have taken that away. It’s like zero tolerance; it’s ridiculous. But it’s the way things are.

People just need to be aware of what the rules are; not what they think they should be. This is the information age; get the information.

I guess all law enforcement agencies are not alike in regards to policy. I do know that Cheatham County does allow the officers to have descretion on the DUI/DWI calls but like your department Domestic Violence is zero tolerance. My son lives down there and some of his friends have been found asleep in their cars in middle of the night and the officer does have the descretion to arrest or not. My son has been called out a few times in the middle of the night by a friend and the officer waits till my son arrives with his tow truck and he tows the vehicle and takes his friend home and tows the vehicle to his lot till the next day. He is not allowed to leave the vehicle with the driver......................... :popcorn:

Lord let's don't break "official policy".
Fortunately, in my personal case, I would not lose my house nor my families security over this. What I WOULD HAVE LOST would have been a little pride in my own personal character that my father and mother worked so hard on all their lives to make me who I am today.

Edit to add: I still stand by my earlier reply. If somebody didn't like it, they can go jump in the lake.......or into a cage about to be set on fire.

2nd edit: this would not be the first job I lost for maintaining my integrity and belief in what is right. Edited by AtomicRooster

Apparently people on this forum though I'm not sure why. I'll never understand why Americans are so obsessed with celebrity news.
