Question for Tennessee LEOs...

Since my HCP permit number is the same as my diver's license number, can the HCP be presented in lieu of the driver's license? 

 

I'm a minimalist as far as my wallet goes, and if it's one less card carted around in there I'm a happier man. :)

 

EDIT: I'm betting no, but it never hurts to ask. :)

No, it is not a substitute. The worst that will happen is you will get a citation and probably be successful in getting it dismissed. Personally, it is not a ticket I would write.

I unknowingly presented mine to Knoxville TSA and while he said if it was up to him he would accept it but it was not and that he could not.

Probably the same guy that I had tried it before and his response was, "I have my carry permit too and it's stupid we can't accept them as I know that you've been through a background check and this is really you." Of course, they used to accept it until about 3 years ago. I traveled quite a few times using it as my ID. I know someone in congress has raised some questions why it's not accept by the TSA since it's a official state photo ID.

 It is not a substitute for a license to be provided when stopped for a traffic stop when driving. But like Patton stated most places if you received a citation for no dl on person while driving you could just bring it and it would be dismissed but not a ticket I would ever write. It would be nice to just have one card that worked for both. I keep both of mine in the same place in my wallet.

From the TSA website....

  • Driver's licenses or other state photo identity cards issued by Department of Motor Vehicles (or equivalent).....you could argue that it should be accepted.... Since tn has driver services and the THP issues the HCP and both are under safety and homeland

I've used my HCP to get through security at both LAX and BNA.

I'll take this in the context whereby specifically a TNDL is either specified or required with the response being...no. But its still a really good question and the state should really just go ahead and do the HCP as an add on to the TNDL and just issue an new DL card instead of the two separate cards.

In this day and age of laptops in squad cars the whole having to have your driver's license seems a little unnecessary. Am I mistaken or can a cop not see your DL photo on their laptop when they look you up? If they can't, WHY NOT? I can get data from around the world in a millisecond, why not that info?

TSA likely should do a lot of things and don't simply because they are the TSA to which there has been many cases of them refusing to accept a TWIC card which is issued  by the very same organization...

Not a driver's license but is a valid photo ID for any other purpose.

 

 

Well, not exactly. TN HCP is not valid for federal ID because apparently you can submit your picture to the state (somehow) rather than having it captured at the DMV. Now, some federal agencies may or may not be aware of this because it was a fairly new policy change. On the books, it shouldn't work for TSA but it doesn't surprise me that it does on occasion.........

I had a TSA agent tell me my diplomatic passport was not a valid form of identification.

 

I'm surprised they didn't think it was some kind of forgery.  A diplomatic passport is probably something they don't see much at all.

Written legal mandate, your TNDL is a privilege, its not a right, but overall you present a good point. What you fail to understand is NCIC is pulled offline daily for updates rendering it inaccessible to an officer until it comes back up. There's a bit more involved as well but another simple answer is not all LEA put mobile data terminals, laptops, tablets or smartphones in their vehicles. I routinely listened to complaints about an officer issuing a proof of insurance, vehicle registration or no DL citation to someone they stopped. It always came down to someone talking about the insurance commercial saying it was accessible on their smartphone.

I'm specifically talking about in the event of being pulled over. When I was a LEO there were no laptops or such in the patrol cars. In Missouri where I was a LEO they changed the DL number to your SS number. I doubt they still do that since your DOB was also on your license which would facilitate identity theft, but back then if a person could prove who they were with their SSN and answer other questions then I wouldn't write them for forgetting their wallet.

 

The simple fix to this would be an endorsement on you DL: problem solved.

Ehh... It doesn't add enough to the wallet thickness to be worth the hassle should you ever need to provide your TNDL to a LEO, so I'd keep it on me. :up:

Yes, they can, but they are systems that are constantly down.

They would have flipped their lid had I pulled out both of my passports at the same time.
