Class III item storage during deployment??

Recommended Posts

So my brother in law is deploying for a few months and has quite a few class III firearms. Up until now we just left them in our personal safes with no ability for others to get into them when we deployed but now his safe will be in long term storage. Has anyone dealt with contacting the ATF and stored items like this long term for someone? Really just looking for someone who has done this by the book here, not just theories. Thanks in advance.

Oh yeah his stuff is in a trust so that should make it a little easier.

Anyone listed on the trust can be in possession of trust held items.

Who's listed on the trust that ain't getting deployed? That's where I would say they should be locked up.

I got an official answer from the ATF. 1) I have to be added to the trust and 2) all items have to have a 5320.20 temporary change of address filled out to the address they are going to be stored at.

My understanding is the 5320.20 only needs to be sent in for Interstate movement. If you will be keeping the weapons at a different location in the same state you shouldn't have to do anything

I was under that impression as well but the email from the ATF said in this case it was necessary.

I would fill out the form without hesitation.  - - with the understanding that whomever replied to your inquiry might not completely understand the policies that they are administrating.

-or they are adopting an unwritten policy of pushing that to keep extra tight tabs on everything that they possibly can.  ??

either way, it's just a form and stamp to be covered according the the Man.

Yeah. He is taking care of them now so they will go through by the time he leaves. I would rather not deal with the nonsense.

I was schooled on this recently by the ATF. Not only do you need a new 5320.20 if you are storing in a new area within the state, if you move to a new address, they require a 5320.20 for the new address as a permanent change. Don't quote me, but the agent said this must be done two weeks prior at a minimum and if you change and don't file, you are in violation and will lose the item, fine, and/or jail time for violation. These were his words.
