William Howard Taft was both President and later Chief Justice, but was nominated by another President (Harding, IIRC).  Not exactly the same scenario, but probably as close as you will find.

They can't stop Obama from appointing someone, but they can certainly block confirming that appointment. And I'm sure they will.

Chris Wallace made an interesting point this morning on Fox News. The current Congress ends on Jan 2 of next year. Obama is President until like Jan 17 or something like that, potentially giving him about a two week window to make a recess appointment as he walks out the door. Would not be surprised.

The work around is to keep the Senate Open until Jan 17 with a skeleton Crew manning thing until Obama is out of Office.
