This was just brought to my attention.  Interesting concept, basically if a business is posted they can be held accountable the safety and losses sustained on their property by handgun carry permit holders.  

 

 

Firearms and Ammunition - As introduced, establishes that if a person or entity posts to prohibit the possession of firearms on the property, the posting entity, for purposes of liability, assumes custodial responsibility for the safety and defense of any handgun carry permit holder harmed while on the posted property. - Amends TCA Title 39, Chapter 17, Part 13.

I've said this for years.

If you're going to deny me my right to protect myself, then it becomes your responsibility to protect me.

Wish they would've added "and family" too.

 

Hopefully businesses will see this could hit where it hurts(wallet) and choose the right path.

Not that it will go anywhere in our not so gun friendly legislature.

The time spent writing this bill could have been used to write a bill to remove the no gun sign criminal penalty.  That would actually help people more. 

 

Instead this bill doesn't remove the no gun sign crime, adds liability to both private business and government, and already has a fiscal note.  It will probably go nowhere.  But I guess the folks who came up with this bill will get their NRA brownie points to get re elected.

Why don't you get with Mark White or Jim Coley (or whoever you Representative is), and see if they will write that bill for you?

Don't get me wrong here, I'm all for carrying everywhere I can, but...

 

Say I owned a restaurant business and didn't have a posted no CCW sign. A customer comes in and for whatever reason the handgun falls on the concrete floor an discharges, hurting or killing someone (and yes it happens)?  Or a robbery occurs and a private citizen gets involved and hurts an innocent customer by his / her actions? Who is going to be a defendant in the civil suit?

 

I'm now a co-defendant in a large civil suit because I allowed the carrying of weapons in my establishment, by NOT posting a NO CCW sign. Isn't it common sense to protect your business from something that can bankrupt you?

 

Just playing the devil's advocate from a legal stand point.

Even if you posted a no weapons sign you could still be sued and found liable depending on the situation. You open up yourself to liability no matter what the law says when you have a business that is open to the public. It's just the way our screwed up legal system is.
