I'm a supporter of the second amendment, any law abiding citizens should have the right to carry. Knuckleheads that give the anti-gun establishment fuel for their fight should get what coming to them.

I guess it's beat up on Spiff night. :D

OK, let me rephrase ... Kids look up to Pro athletes. They try to emulate them.

I'm not going to get into dissecting what people say and pick it apart, so I'm done.

Yes some kids do look up to them. But I think it would be easier to try and teach the child right and wrong yourself rather than to try and change the behavior of an over-paid, spoiled adult, was all I was trying to say.

Sort of feels like more people are wanting him to go to jail for not carrying in a proper manner resulting in a ND and/or carrying in a nightclub than what he may go for. Which is simply having a handgun in his possession, something many of us do everyday.

As I said, he broke the law and I'm sure he knew he was and he should have to face the consequences. But if TN tried to pass the same law here that NYC has how well do you think it would go over?

Even in Tennessee, if I were carrying in a bar, drinking alcohol and shot myself, I would be facing charges. Not as severe as New York, but I would still be in hot water.

Yes, and we in TN have been trying to get part of those laws rescinded (pushing for carry in restaurants that serve alcohol) because they're bad laws.

But, if you'll recall from the article, Plaxico isn't being charged with shooting himself, or carrying while drinking. He's being charged with mere possession of a handgun--an "offense" which is an egregious infringement of the 2nd Amendment.

It doesn't matter that he was drunk.

It doesn't matter that he was carrying in an unsafe manner.

It doesn't matter if he was acting like an ass.

None of those are issues which are going before the judge who will, barring some legal gymnastics that wouldn't likely be performed for you and me, be compelled by the law to sentence him to 3 1/2 years in prison just for carrying a handgun.

That is my point....those things are either not against the law in NY (Pretty sure carry where alcohol is served is not) and/or at the very least he is not being charged with them. He was in NY, not TN, you shouldn't apply TN law as to whether you think he should go to jail or not.

Now granted NY and NYC have a permit system and if he would have had the proper permits he would have been legal. But there is a big difference between places like TN and other states that are shall issue and places NY and others that are may issue to the point they are almost non-issue.

Again I am not saying he is innocent, just it seems some people want him to go to jail for doing thing that are illegal here or even just because of the way he dresses. Instead of what he is actually being charged with.

I don't disagree with you. I do think that two issues naturally present themselves: New York's draconian gun laws and Burriss' dumb behavior. Had his Glock been holstered, he wouldn't be having to deal with New York's gun laws.

i've spent my fair share of time in crowded NYC nightclubs... it's his good fortune he only shot himself and not a bystander, he should go away for a few and consider himself lucky.

Does anybody remember the deal with Carl Rowan way back in the 80's in DC. They had mandatory sentencing for unlicensed handguns, he was a big anti-gun writer, and he shot a teenager in the hand for being in his pool with his illegal handgun. Best I can remember, he got off scot free.

As to this situation, I hope they are forced to sentence him to the max, not because I think he deserves it(he does) but it will draw attention to the stupidity of these laws in the NE US like the Sullivan Law.
