New 2016 Tennessee Laws That Go In Effect 1/1/2016

Always find these interesting, assume you do as well.  Feel free to add/correct, etc.

  1. Tire Environmental Act---more stringent efforts to prevent tire disposal in our lakes/streams.
  2. One-year suspension of driver's license for failing to stop at the scene of the accident and if not in compliance with the Financial Responsibility law increase penalty to class B misdemeanor
  3. Registered nurse anesthetists can now write prescriptions.
  4. Requires TBI to form human trafficking advisory council.
  5. Registry for medical spas.
  6. High school students must take a civics class/test.
  7. Stem initiatives must go into rural areas.
  8. Allows for Transdermal monitoring for certain persons charged with vehicular assault and prior DUI's
  9. New type of company called a "For Profit Benefit Corporation"
  10. Don't have to wear a motorcycle helmet if in a funeral procession, memorial ride or police escort.
  11. Abortion laws 48 hour waiting period, informed consent, ultrasound and if perform over 50 abortions/year have to be licensed as an ambulatory surgery center.
  12. Kate Webb Act--requires all infants to be tested for specific genetic, metabolic or other inheritable conditions.
  13. More control of medical pain management clinics.
  14. State/government cannot subpoena a clergy member's sermon.
  15. Restrictions on traffic cameras as the basis for speeding tickets.
  16. Univ. of Memphis---can admit with instate tuition individuals who are immediately adjacent to Shelby County and no greater than 30 miles away.
  17. Prohibits production/manufacturing/sale of synthetic cannabis.
  18. TN Animal Abuser Registration Act.
  19. Class a misdemeanor to be a spectator at an animal fight.
  20. Opioid Abuse Reduction Act---study opioid abuse in state.
  21. Lifetime handgun carry permit--$500.00
  22. Diabetic testing supplies are exempt from sales and use taxes.
  23. Under 18--no Vapor product.
  24. If you own a Class 1 carnivore--has to have a microchip.
  25. Driver's license now good for 8 years vs. 5.
  26. Authorizes use of cannabis oil to treat seizures.
  27. "Tennessee Weekend of Prayer over Students" 1st weekend in August--by Governor.
  28. May be absent from your work to vote from 2.5 hours (used to be 3).

Hm. #15 has me curious. I like the sound of anything that may curtail traffic tickets! ;-)

However, red light cameras aren't my problem... it's those annoying speed limits!

Will the HCP adjust with the DL length? Mine don't expire at the same time so it's not a concern for me. For some reason they are a year apart now.

As I read this act I thought its now a mandatory test, which the patient pays for, which only affects 1 in 100, 000, and if I read this right; it mandates that newborns get tested early...Wouldn't it be better to do blood tests on adults to see who is a carrier of that recessive gene?  When I got married, both the wife and I had to have blood tests before they would issue a license; I don't know what they tested for or if they are still doing that but it seems to me that it would be better to test adults to see what couples are at risk.  If a child is already born it may be too late to start testing if they already have the condition, it has to be caught before birth to begin treatment as soon as they are born and give parents the opportunity to choose whether to have kids or not.

12 - Kate Web act... Sounds to me like this is the creation of a mandatory DNA database...

 

 

 

On a lighter note: I'm pretty sure I used to be married to a class 1 carnivore. A chip would have been useful in narrowing down which bar she was drunk in when I had to go find her...

 I guess you could say, these are water under the bridge but I have some concerns about some of the things coming up in 2016. 

 

 

3. Attorneys paid $75/hour to represent indigent criminal defendants. (Our tax dollars? You think Medicare fraud is bad, let the lawyers get their hands in the till)

6. Requirement to have remedial programs for students who test less than ready on ACT. (Accept the fact that everyone is not college material)

7. Prevents smoking on state property. (This just covers too much area, state parks, roadside parks, etc.)

11. Greater than 76 years old must pass vision test to renew driver's license--unless have written statement from Dr. (While it might be for public safety, this is age discrimination)

15. Cannot bring handgun into a public park if ticket or pass required. (Require a pass, even free pass, to use public parks and we've lost what we've gained)

17. Prohibits renewal of Sons of Confederate Veterans license plates. (Just for general principles and to p#@s off the folks who object to anything pertaining to the Confederacy.)

No, not so far.  

 

I've ranted about this for some time. All the effort over last 2 years on getting the HCP to hit the 5 year thang has been wasted, and it's still being done.

 

If TN extends does HCP to 8 years, likely to lose reciprocity from various states, too, unless they still run recertification background checks at 5. And not that it's likely to happen, but for permit to stand in lieu of background check for 4473, recertification background checks can be no less than 5 year.

 

Wait and see if the legislature doesn't royally screw up the HCP one way or the other much worse before long.

An alternative is to pay the $500 lifetime handgun gun permit..................assuming its cheaper in the long run!  ;)

That won't help if other states quit recognizing it. That's the main danger I see.

 

I'm a bit surprised the lifetime thing hasn't arisen yet in that regard -- perhaps TN still does a 5 year background check with them?

Huh? Your numbers don't match up with the list in the OP. For example, your #11 is about driving, while #11 in the OP was about abortion. Are your numbers supposed to line up or is there something else they are referring to that I don't get?

#10 is interesting, I used to ride, and lived in FL, where no helmet is the norm.  I realize it's a personal choice where allowed by law, but those exceptions will lead to every saturday morning ride be a "benefit or memorial" ride for something or someone.

About damned time! I think one of the biggest problems with government today is that young voters have no clue as to how government actually works. Or, more often than not, how it doesn't work.  :poop:

Does #10 replace the current rule that local authorities may approve no helmet for parades under 30 mph?

 

Wasn't aware of this, but I don't know.  Personally, I think there is a higher risk of dumping the bike in slow formation/parade riding than any other time, but that's just me. Not much "reaction time" room in parades.

Whole lot more reaction time at under 30 mph, than there is at 80. Anytime you're riding in a tight formation, especially aide by side there is a risk. I will say I'd rather just see the helmet law go off the books. We are all big boys and girls. If I'm adult enough to survive on my own, then a helmet or seat belt should be my choice to make.

This is completely dependent upon who makes the test and what is contained in it. Sadly, I believe it will most likely have serious statist/socialist content designed to further indoctrinate the youth of this nation into a willing slavery to government for "our own good."

Looks like the change adds to the current law.   TCA 55-9-302, b 4 still allows no helmet in parades  ( I think my "police permission" came from my motorcycle safety class as a suggestion to ask first rather than assume the law was known by the locals)   b 5 appears to be the addition.  It specifies funerals, memorial rides under police escort, and body escorts that are under 30 mph, rider (and presumably passenger) are at least 21 and distance is no greater than 50 miles.   So taking off with a bunch of buddies on a Saturday and calling it a "memorial ride" are out unless you convince the police to escort you. 

 

For me, if its over a "walk your bike" parade speed I'm covering my noggin with an approved helmet.   I am a member of Patriot Guard Riders so I'll be wearing my helmet on these missions even if it is around the block.

Not much reaction time when your bike's front tire is 10' or less behind the rear wheel/bike in front of you.  I refused to ride side x side even with people I rode with on a regular basis.  Side x side in tight formation with people I don't know, no thanks.  I agree on the helmet, you decide.  I used to argue and fuss about seat belts but have gotten use to them, and use them now.  Still don't like 'em, but I use 'em.

Not much reaction time when your bike's front tire is 10' or less behind the rear wheel/bike in front of you. I refused to ride side x side even with people I rode with on a regular basis. Side x side in tight formation with people I don't know, no thanks. I agree on the helmet, you decide. I used to argue and fuss about seat belts but have gotten use to them, and use them now. Still don't like 'em, but I use 'em.

I ride with a club. We are side x side on the interstate. State and secondary roads it depends. If it's fairly straight it's side x side, anything else is staggered. Most of the time I would say there is 4-8 ft between our tires. It's part of it, we all ride together a lot, and hangarounds and prospects are introduced into the pack slowly and carefully. I've actually got a 60 mile ride tomorrow
