How can Hillary even be considered as Sec of State?

U.S. Constitution - Article 1 Section 6

Article 1 - The Legislative Branch

Section 6 - Compensation

No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office.

During Hillary Clinton's current term in the Senate, the salary for Cabinet officers was increased from $186,600 to $191,300. Since the salary is scheduled to again be raised in January 2009, not only Hillary Clinton, but all sitting Senate members could be considered constitutionally ineligible to serve in Obama's Cabinet.

My bad - HRC didn't vote for the raise. A 2008 executive order from President Bush created the increase, based on cost of living adjustments, leading some to argue that appointing Clinton doesn't violate the spirit of the law in Article 1, Section 6.

I can see where some might say that her appointment might not violate the spirit of the wording, but it would indeed violate the wording.

Mike is correct. The rules only apply to those other guys. Besides we not only have the new JFK/MLK we also get the smartest woman in the world. Maybe Bill will come alone for the fringe benefits. :lol:

The only comfort and relief I had been able to find in Obama's campaign and election was the notion that at least, the Clinton's would not be as influential as they would have been if Hilary got elected. Oh well, there goes that pipe dream. However, we should all remember that "we the people" are still in control of this country whether the powers that be approve or not. LET YOUR VOICE BE HEARD! Write your congressmen regularly and urge other people not to roll over in the face of adversity. I think "good Americans" still outnumber those who would would see this country turn into some liberal quasi-socialist, elite ruled monarchy. They may have more money, media cooperation and political influence, but WE ARE AMERICA. Lets make some noise people.

Fox news just had a report about this. The way they get around the law is for the person taking the office to be paid at the salary before any increase they could have voted on. After all money is not why they want a cabinet post.
