Moving In State

Ok guys need some help here. We are moving, not out of state, only about 2 miles away. I have a trust, and a few NFA items. And 1 SBR waiting to be approved. 

 

I have heard that I don't have to file with the ATF that I moved, also i have heard that I do. 

 

Anyone who has gone through this will you share with me your experiences? Thanks in advance.

You don't have to. But it's a good idea. It removes possible delays and confusion of you try to file any future buys or transfers.

I moved 3 times in 15 years but all in the same county. My dealer told me that if it is in same county it was not required.  I never did file a "change of address" until the last time I moved (still in same county) and only when I was wanting to take multiple items (that had different addresses on the form 4s and form 1s) out of state and had to fill out 5320.20 form. To eliminate any confusion at ATF I went ahead and filed my change of address before I sent in the forms to take them out of state.

Just sent out an email to my lawyer and a buddy at the ATF. Hopefully we will have an answer shortly. I did a bunch of moves when I was in the military but I did a temporary movement for a year because I was all over the place.  (ex. if there is a place like a family farm in Georgia you go to often you can fill out the temporary movement form and the ATF will validate it for an entire year so you don't have to do it every time).

 

Do you have everything in a trust or under your own name?

Everything is under a trust. And the trust is not associated with an address.

It's not mandatory but I would highly suggest once you're settled and its determined that you will be there for some time, to file a 5320 and mark permanent. When it comes back just keep it with your forms and you're super covered.

You don't want to be questioned while out and about someday when your form 1/4 says this and your driver's license says that.

Trust are associated with an address as it relates at time of approval. Same as an individual is associated with an address when theirs is approved.

Most trusts are also not always clearly named so that smoke adds to confusion.

Then Mike Dresner gets asked for his forms one day at a range and now all of a sudden Mike lives at 456 New Address.

And as C-H-L above said, if you ever wanted to interstate it could give them reason to not approve your 5320.
