Question about legal obstacle getting HCP.

I have a friend who just sent in his paperwork for his HCP and received a letter back requesting the disposition of a 1974 simple possession charge, of which the case was dropped. The problem is that he was arrested in Davidson County, yet Davidson County has no record of the case. My friend does not know how to go about getting his HCP at this point, anyone have any advice?

I got a DUI when I was 18.  Twenty five years later I was doing volunteer work in Jails and Prisons in GA where I lived at the time.  The state did an extremely thorough background check in order to allow me in prisons.  

 

The DUI was on there, which would have been fine after that amount of time, but it didn't show that I went to court and paid the fine.  DUI wasn't a serious offense back then - $250 fine. I called the county where it happened and learned that they tore the old courthouse down and didn't have anything on me, that they threw away the closed files.  

 

She  asked why I was calling.  Once she learned why, their judge faxed a letter to me saying that it had been resolved.  

 

Maybe approaching this in a similar manner will help.  If not, I'll bet a lawyer can help you.
