Lawful rifle carry in a pickup - TN & AL

Going to Bama for the weekend, I have a HCP for TN... so I'm good on that front. But I want to bring my AR with me. What's the best source of current information on lawful carry of a long gun, in a pickup (in the cab so accessible) in TN and AL?

 

Didn't know if there was anything funny about it.

 

I'm assuming, of course, unloaded.... Unloaded mags? Ammo in a separate container?

 

Googling took me to state law PDF's that are 1,000 pages long..... ugh.. :surrender:

In AL the gun owner must keep the firearm locked in a compartment or container that is affixed to the vehicle. The firearm must remain out of reach of the driver and any passenger in the vehicle and be unloaded with ammunition in a separate container (Can be in the magazine still).

With an HCP in TN you can carry it loaded and chambered. Not sure about AL though

You no longer need a HCP to carry a loaded firearm in vehicle. Long gun or short

I'm heading to Alabama for the weekend as well, but I think I'll just stick to handguns with me.

 

I've searched for info before, but never found 100% sure if its legal to have a loaded rifle with you in AL… you do have to have a permit to carry to have any loaded weapon with you in your vehicle in Alabama.  Here in TN though, you can have rifles, shotguns, pistols, whatever in your car… no carry permit needed, unless your parking and leaving the weapons in a "gun free zone" parking lot.  In AL, signs don't carry weight of law.

I am pretty sure you can have a loaded long gun in your vehicle in Alabama.  I don't know if it can be concealed or if it needs to be in the open when it is loaded.

I know some places make stipulations about "out of reach" but that in a pickup, they can go either way since even in my crew cab... everything is "within reach"....

 

Mainly concerned about that part. I know some states make allowance for pickups or other vehicles without a trunk.

While you're in TN, you're GTG however you want to carry it.

 

I have a cheap "parts-bin" AR in a rack behind the seats pretty much 24/7.  Loaded magazine, empty chamber.  (The chamber can legally be loaded as well, but IHMO that's not a great idea for vehicle carry of long guns.... but that's another subject).

No, you cannot have a loaded long gun in your vehicle - in AL that is concealed. There is only concealed carry for a pistol.

 

§ 13A-11-50 Carrying concealed weapons. Except as otherwise provided in this Code, a person who carries concealed about his person a bowie knife or knife or instrument of like kind or description or a pistol or firearm of any other kind or an air gun shall, on conviction, be fined not less than $50.00 nor more than $500.00, and may also be imprisoned in the county jail or sentenced to hard labor for the county for not more than six months.

 

§ 13A-11-73 Permit to carry pistol in vehicle or concealed on person -- Required; possession of unloaded pistol in motor vehicle. (a) Except on land under his or her control or in his or her own abode or his or her own fixed place of business, no person shall carry a pistol in any vehicle or concealed on or about his or her person without a permit issued under Section 13A-11-75(a)(1) or recognized under Section 13A- 11-85. (b) Except as otherwise prohibited by law, a person legally permitted to possess a pistol, but who does not possess a valid concealed weapon permit, may possess an unloaded pistol in his or her motor vehicle if the pistol is locked in a compartment or container that is in or affixed securely to the vehicle and out of reach of the driver and any passenger in the vehicle.

 

(2) FIREARM. Any pistol, rifle, shotgun or firearm of any kind, whether loaded or not

If you had the long gun in a rack in the open, it should be legal when it is loaded because it wouldn't be concealed.

 

Negative - you cannot.  That violates the law in AL, in a vehicle visible or not you cannot transport a loaded long gun. Pistol all day long but when the weapon is in a vehicle in the passenger area it's considered under immediate control and thus it's considered on your person. If you're going hunting it still cannot be loaded, can be in a rack etc, however, ammo must still be separated and they routinely check your hunting permit.

 

§ 13A-11-50 Carrying concealed weapons. A person may lawfully transport a firearm, including a handgun, from one state in which they are legal to possess to another state with or without a permit as required under Alabama law, provided the following conditions are met:  The firearm is unloaded.  Neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle.  In case of a vehicle without a compartment separate from the driver's compartment, the firearm and ammunition shall be in a locked container other than the glove box or console. Title 18 U.S.C. section 926A
