Transporting AR 15 with Ammo

Recommended Posts

I have an M4gery I carry (completely unloaded) in a Drago three pocket tactical rifle case, along with some empty magazines carried in one of the external pockets. I would also like to carry boxed ammo in one of the pockets to and from the range, but I'm afraid of violating a TCA by carrying a rifle and ammo in the same case. Seems guns are often considered loaded by the courts if they are transported in close proximity to the ammo supply. Can anyone comment on the legality of doing this?

OK, second question - same deal but I'd sometimes like to conserve range time by loading some mags at home the night before. Where do I stand with loaded mags in the same rifle case with the rifle?

Any help appreciated.

You can carry loaded mags in the same case as the AR if you have a permit. The rifle can be loaded, but not chambered. One of the benefits of having a permit. I normally load all my AR mags at home.

I was under the impression that is no longer the case. When they passed constitutional vehicle carry back on 7/1/14 I thought you could now carry with a round in the chamber either with or without a HCP. This applied to any firearm, not just handguns.

Mac should be along shortly to correct me if I'm wrong.

39-17-1307.  Unlawful carrying or possession of a weapon.

  (a)  (1) A person commits an offense who carries, with the intent to go armed, a firearm or a club.

   . . . . . .

(e)  (1) It is an exception to the application of subsection (a) that a person is carrying or possessing a firearm or firearm ammunition in a motor vehicle if the person:

( B ) Is in lawful possession of the motor vehicle.

   (2) As used in this subsection (e):

      (A) "Motor vehicle" has the same meaning as defined in § 55-1-103;

( B ) "Motor vehicle" does not include any motor vehicle that is:

         (i) Owned or leased by a governmental or private entity that has adopted a written policy prohibiting firearms or ammunition not required for employment within such a motor vehicle; and

I stand corrected. I figured Mac would straighten me out.

I got pulled over the other day for going 5 mph over and I informed the cop that I was armed and also had a 12 guage in the car, and he looked at me wide eyed and said, "What do you need that for?"

lol.

The classic joke regarding the little old lady who responds to cop inquiry:

"yes, I've got a .45 right beside me, a shotgun behind the seat, and an AR-15 and AR-10 in the trunk, with plenty of ammo for all of them".

Cop: "Good Lord lady, what are you so afraid of?"

Lady: "Not much of anything".

You know, I have found that if I put on my seat belt, obey ALL the traffic laws including the speed limit and mind my own business, no one really cares where my guns are in the car.

Just store them responsibly and drive safely to your destination.  I'll give 99.999% guarantee you'll never have an issue.

As of 7/1/14 I started carrying a .44 mag, fully loaded, down the crack between the driver's & center seat of my truck.
Not because I think I'll ever need it, not because I'm paranoid, not because I live in a high crime area...but because for the first time in my 40 years on this rock, I can & the Law says I can & that, THAT, is why I spent hundreds of thousands of dollars to be able to live here.
