Senate Bill 0314 Park Carry

We need to get behind this bill and also the house companion bill when it is introduced.  This bill will legalize handgun carry permit holders carrying handguns in all parks.  It seems to be a good bill and provides a clean exception for handgun carry permits.  Hopefully a house bill will be introduced soon.  This bill should be a big priority for us to get passed.

SENATE BILL 314

AN ACT to amend Tennessee Code Annotated, Section 39 - 17 - 1311 , relative to the carrying of weapons.
 
WHEREAS, the General Assembly of the State of Tennessee has demonstrated its intent to control the entire field of the carrying of firearms with in the State of Tennessee; and
WHEREAS, the Legislature shall have the power to regulate the carrying of firearms as delegated in Article I, Section 26, of the Constitution of Tennessee; and
WHEREAS, the National Rifle Association has committed, during the period of April 8–14, 2015, to holding its 149th meeting of the membership of this organization in Nashville, the capital city of the State of Tennessee; and
WHEREAS, these members attending will travel to Tennessee from parts of all fifty states of these United States; and
WHEREAS, it is expected some ninety thousand members of this organization will attend and participate at this annual meeting, and these members will come from states that allow the carrying of firearms in some form or other; and
WHEREAS, it is reasonable to expect that most of these members attending will be inclined to want to carry a firearm for their personal defense and protection; and
WHEREAS, across the State of Tennessee there is a patchwork of local and State laws concerning the allowance or prohibition of the carrying of firearms within the areas of certain parks and other recreational areas;
now, therefore, BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
 
SECTION 1. Tennessee Code Annotated, Section 39-17-1311( B)(1)(H) , is amended by deleting the following language:
-, while within or on a public park, natural area, historic park, nature trail, campground, forest, greenway, waterway or other similar public place that is owned or operated by the state, a county, a municipality or instrumentality thereof, except as otherwise provided in subsection (d)
 
SECTION 2. Tennessee Code Annotated, Section 39-17-1311(d), is amended by deleting the subsection in its entirety.
 
SECTION 3. Tennessee Code Annotated, Section 39-17-1311(e)(1), is amended by adding the language “remove,” immediately after the language “shall not”.
 
SECTION 4. Tennessee Code Annotated, Section 39-17-1311(e)(2), is amended by deleting the subdivision in its entirety.
 
SECTION 5. This act shall take effect April 1, 2015, the public welfare requiring it.

It would be nice if it said:

 

WHEREAS, this legislative body began allowing guns in state parks and it has not developed into "blood in the streets" regardless of what Nancy Amons and Gail Kerr think.

Wow, that is a hard time line to get it passed and signed into law...  but with the NRA coming here, it might be enough of a motive to get the legislature to pass something.

Goins filed the House correlate today.  HB 0274.

 

We'll see how deep the Gov buries these if his pet projects get axed (Insure TN and the gas tax).

Rep. Goins is a really good guy, former Marine, and is doing his best to make this the right bill.  He absolutely deserves our support for his efforts on this.

Yeah I'm hoping this makes it out of the committees and is allowed a floor vote as a clean bill.  Hopefully it doesn't get thrown in that finance committee again.

Given today's demise of Haslamacare, this bill likely has the wrong sponsors to go anywhere except the dung heap.  Hell, it has the wrong intent to go anywhere else, either, now that King Billy got a thumb in the eye.  You can bet dollars to donuts that this one, Nicely's SB0207 (valid HCP instead of a TICS check for firearms purchase), Kelsey's SB0070 and Green's SB0149 will be "flagged" by the administration, and extraordinary pressures will be brought to kill them in committees, if they ever even make it that far.  Same goes for their House correlates.

Sun Tzu would tell us now is the time to scale the walls, embolden the masses to gather the troops for an assault while the enemy is disheveled and searching for answers to wth just happened to the Oligarchy:

“If your enemy is secure at all points, be prepared for him. If he is in superior strength, evade him. If your opponent is temperamental, seek to irritate him. Pretend to be weak, that he may grow arrogant. If he is taking his ease, give him no rest. If his forces are united, separate them. If sovereign and subject are in accord, put division between them. Attack him where he is unprepared, appear where you are not expected .”

Though it is wise to remember the wounded bear is the more dangerous.

If I thought the Oligarchy was in sufficient disarray, I would agree...and, they may be and the bills will have a successful foray through the LP.  However, I suspect that one of the reasons Haslamacare was pushed to the extraordinary session was, in fact, in anticipation that there was a possibility of failure with going the resolution route...and having that happen in an extraordinary session could give opportunity to bully through other better-camouflaged legislative efforts towards the goal.  I would speculate that the admin will be working tirelessly behind the scenes (despite his "well, I guess we're done" pressers) to both punish those who led efforts to defeat the resolution (by hamstringing most-to-all of their sponsored legislation, for starters) while simultaneously baiting legislators with various back-scratching "deals" for their souls.  I trust King Billy (and his political and legislative "buds") perhaps even less than the Obasm...and, as WM points out, there is now a wounded, vindictive bear afoot.  A wounded vindictive bear with very lofty aspirations.

Of consideration:

King Billy is term limited, and as such will not be able to fly cover for Madam Speaker much longer (and, her wanting his still warm seat).  Cash still being king we understand, but the ability to make appointments and such give great strength, however when such power is waning (lame duck and all) Madam Speaker may just want to drum us some bona fides re conservatism of her own and allowing a few gun bills though might buy her some rednecks...and Ramsey, why he is the most 2nd Amendment friendly guy out there (cough).

We may have the A Team in place and not know it yet.

Well, I see they jumped right out and stuck typical yellow journalistic labels on several of the pending pieces of legislation: "Guns in Trunks", "Guns at Schools", "Major Weapons", "Guns and Criminal Background Checks".  You'd think some of this was written by the same folks who scripted the 'Tennessee for Success' commercial I just saw on TV...oh wait...

My understanding is that the powers that be want March 10-11 to be "Gun week", line them up and kill them all in one fell swoop, so they can get on to other more important theft of Rights/money unimpeded.
