Need info!! CCW permit question

I am a new resident to TN and had a question about CCW and DUIs. I had a bad lapse of judgement and got two duis in 2009 back to back. Before you judge. I know the wrong doing and dumb things I have done. My question is can I get my CCW. Both of the DUIs are over five years old im just a little confused with the "and" statement in the laws. Please help.

No, you can apply for carry permit on the 10yr+1 day anniversary of your first conviction(of the pair) assuming you aren't charged again between then and now. So sound like 2019 sometime. If you were charged again there would be a min. 5 year wait from that conviction.

 

"The applicant has not been convicted of the offense of driving under the influence of an intoxicant in this or any other State two (2) or more times within ten (10) years from the date of application and that none of such convictions has occurred within five (5) years from the date of application or renewal."

Ahh the crap we do in our youth.

what you are asking is if you can break the law.  Yes, you can.   This goes back to those same ideas about dumb mistakes made in youth (or whenever).   You might get away with it.  We do not advocate breaking the law on this forum ... if you want to play that game, you have to be ready to suffer any punishments that fall your way if you are caught.  Just like the DUI... consequences.   I strongly advise against breaking the law, but you certainly "can".

 

In this case, I think you just get denied and no real harm done.  But in the worst case, you knowingly get your permit and they find out about it later...  and come calling.  What happens then?  I don't have a clue.  But it can't be good.

 Don't try it please. If you intentionally answer the application wrong to get a HCP it can come back and bite you. And that won't just be bye bye HCP. I have seen it happen once.

When you got your Tennessee Driver’s License one of the questions was “Have you ever been convicted of DUI in any state?” How did you answer that?

I wouldn't ever lie on an app. Just wanted to know if it would be overlooked thats all.

On the upside, you can keep a loaded gun in your car, but yeah, no go on getting the permit for the next 4 years or so.

As long as your legal to own the firearm you can have it loaded and ready to rock in the car. No HCP needed.

Handguns.  You may NOT have a loaded rifle in the car.  You can have a loaded rifle mag / empty rifle chamber in the car WITH a HCP.  Hopefully this is still correct, stuff changes a bit.

 

Yes, carry is carry in TN, need permit for loaded handguns unless hunting or on private property.

They will be looking at that info when they process your application. They will specifically check the state you surrendered your license from.

Ok. Let me wrap my head around this. Loaded ready to shoot pistol ok in car. Loaded rifle not. Is that right? And any recommended classes for my wife to take shes a newbie. We live in clarksville.

the permit *requires* taking a class.  So do that class first ... someone can point you to something in your area.   It will cover the basics including shooting the gun a little under simple conditions.

Sorry but that's incorrect. As per your quote above, there are two conditions:

 

Condition 1: 2 or more DUIs in last 10 years

Condition 2: At least one DUI in last five years.

 

The "and" is important - both conditions must be met to deny HCP. Two or more DUI convictions in last 10 years, each over 5 years from date of application is not a disqualifying situation.
