Permit holder arrested for carrying in school...

Yesterday, a permit holder entered Gateview Elementary in Portland to pick up his child carrying his pistol.  PD was called, and he was arrested.  How stupid are some people?

Open carrying? Or visible under his clothing?

 

Bad place to attempt either. But if you just gotta carry there...cover it well.

My question is, how did they know?  Was he swinging it around like a purse?  

 

Surely no one could be dumb enough to open carry into a school.

 

I was just at a high school basketball game last night and by the looks of most of the attendees,   I'd be willing to bet there would be many folks carted off for that if they searched everyone.

Well I'm going to try and give the guy the benefit of the doubt a little but just a little. Of course I don't have children in school but I will admit I have walked into a few Government places while armed and concealed but because I am so use to wearing a firearm it's like wearing a ball cap or sunglasses on a sunny day. You put them on but don't think them any more about it until you need them. Now if he walked in the school looking like Matt Dillon with it hanging out or wearing a large gun that prints to much, he deserves what ever he gets because it's a lot harder to forget when you have it open carry or large frame gun that prints well I believe...............................jmho

One of two things ...

Why did it take him so long to pick up his daughter, that someone had time to call 911 and the police to arrive before he could leave. No one except a LEO could physically detain him correct? (At least not without the possibility of some legal repercussion for holding him against his will?)
...
Or congrats on the local LEO for such a quick response time ...

Whichever of the above is true ... Definitely wasn't a smart move on his part.

Anyone have a link to this story? For now I am siding with Bersa. I am not going to admit to anything, but lets just say that I am a parent volunteer at my sons school. I do normal volunteer duties as well as many other things for the school. I show up when my sons class has a pull out so I can get a verbal passdown on the things his teacher wants done. There are times that I am doing my normal running around before school. I have had to leave a few times for a few minutes due to me forgetting something. Oops

Well I admit the Police were there pretty quick but then most folks are not aware of the fact that almost every school does have a police officer or two parked near the school in marked and unmarked cars when school is receiving students or releasing students so most likely they were right around the corner to show up so quick.

Yes, I got stopped several times until I was well known. That is when I was working the auto parts business. I serviced the Auto/Shop class at Franklin HS about 6/7 years ago. You may not notice them, but the LEO is always close by. Even that long ago.

There is one on campus at all times at CCHS, he sits in a little guard housing in the parking lot when not making rounds. It's usually a new city cop or one getting close to retirement

Update. Apparently his wife hung him out. Don't know what he did to piss her off, but she feigns her own illness and sends him on an errand to pick up the kid at school. She then calls the PD to inform them that he's in the school with a gun (apparently she knew of his penchant for "concealed means concealed"). They arrive while he's in the building, check him, and sure enough he's packing. Wow. Creative revenge on her part, I reckon.

So do we assume that since the police had reliable witness information (his wife), they could legally detain and search him and it won't get thrown out?  What if some random person told the LEO you were carrying (as in, they didn't actually know and were lying about their knowledge of you carrying), does that give them probable cause to search you without your consent?

That seems remarkably short-sighted on his part.  I wonder if he thought it would go better by consenting?

All searches will be tested by your defense attorney if you are going to trial. It's then the Judges call.

The Police rely heavily on citizens’ complaints. So if someone calls in and says you are carrying a gun in a school the Police are going to show up and pat you down for weapons.

Carrying a gun in Tennessee is a crime; so articulating RAS or PC is pretty easy.
