TX Man, Justifiable Defense, but Felony Anyway?

We bitch about our 'meanor criminalization of carry past signage, but in Texas it's a felony to carry into a  posted "51%" alcohol serving establishment.

This fellow may well be seen as a hero, but is on the lam for having his heater with him in there in the first place.

I read that earlier and figured that because he left he was either drinking or dealing with some stupid law.
He would often walk the women to their cars after their shift.

Obviously a bad area. Hope righteousness prevails! Edited by Ugly

Well, it's a felony whether you drink or not. Plus like here, a separate charge if carrying while under the influence. Dunno if that one is a felony there too, or just a 'meanor like here.

Big diff is that here, it's not a crime to enter an unposted alcohol serving place of any kind carrying, and actually if firearm is used in justifiable defense, any/all charges in the weapons section go out the window anyway.

Hopefully this case gets the law changed. This man likely prevented several deaths of actual humans. I wish him the best.

Doesn't TN have a law that prevents you from being charged with other firearms related offenses? I am assuming that Texas doesn't have a law like this, otherwise this would not be an issue.

Yes to the first and the second.

We do....they don't.

Circuit Court Judge Thaddeus Jackson Breen: Major here has told me what your troubles are. I've been thinking it over and in light of my forty years experience in legal jurisprudence, I have come to the positive conclusion that there ain't no way to do this legal and honest... but being good sensible Texans, we'll do it illegal and dishonest!

I guess being sensible Texans is a fallacy.
