Hello all!

 

Some of you may know me from my work with Knife Rights and our success in overturning the switchblade ban in TN as well as enacting knife law preemption protecting you from local knife laws.

 

I am still with Knife Rights but have started a new organization dedicated to advancing NFA issues around the country including passing "Shall Certify" legislation, as well as repealing and replacing the "defense to prosecution" (DTP) laws in the states that have them. We would replace DTP with language that simply says you can own NFA items "in compliance with federal law".

That's interesting.  According to that map, Tennessee is one of only 7 states to have a "shall certify" law so the local LE Chief has no option but to approve.

Yes, that is true. But it isn't unlimited. Tennessee case law (originating out of Williamson County) holds that the CLEO does not have to sign the certification in exactly the same manner as the ATF has on its form. It the CLEO marks through some of the certification, then the ATF will not approve the transfer (which is what happened in that case). We also know that some CLEOs still will not sign. You are basically in the position of trying to force their hand through the courts.
