Tradeing an ak74

I'm looking at trading an ak47 rifle, not pistol to a tn resident. However he does not have a tn drivers license. He's trading me a pistol which we are going through shooters depot in chattanooga for the transfer it with it being a long gun does it require an FFL as well? In his home state? Or can we just walk out of the store and hand him the rifle? Hope that's not too confusing. Thanks in advance.

Some form of ID the shows they are a TN resident is a good safe and legal way to trade firearms rifle or pistol.

 

No legal need to go through any FFL if you are both TN residents.

Simple, ask him " are you 18, a tn resident, and legally allowed to posess a firearm?" If he answers in the affirmitive, make the swap. That said, If you or I feel the need to get Uncle Sugar involved in our private business, "just in case", im not comfortable with you in the first place and wouldn't swap baseball cards let alone firearms. My two cents

Is a drivers license not needed for the "proof of residence"? Isn't that how they sort it out when you fill out a 4473 at the gun shop?

You should handle it however you feel comfortable, I was simply giving my opinion. That said, gun stores also fill out the aforementioned 4473, perform a background check, and collect sales tax.

I just ask 'are you a resident, are you legally allowed to own this item?' 

 

I then end with 'Have a great day.'

 

However...

 

If someone approached me for a trade/sell and told me upfront they had no ID, I would tell them to pound sand. I wouldn't ask to see it, but if you start volunteering information like that, my spidey senses will start tingling.

When I first moved here I used a water and electric bill to pick a gun up I had transferred in to prove my address at the LGS. Don't always need a DL.

Are you both not from Tennessee?


He recently moved and says he's waiting to close on his house. Just don't want to venture in waters where I'm over my head

Private transfers:

 

illegal for a seller to transfer to anyone who he "knows or has reasonable cause to believe does not reside in ... the State in which the transferor resides."

 

illegal for a buyer "to transport into or receive in the State where he resides ...any firearm purchased or otherwise obtained by such person outside that State."
