if your order a brand new complete lower,can it be transfered as a pistol even though it already has a stock on it?it wouldnt have been fully assembled as a rifle,so would it be a no go,or ultimately up to the gun store?

The ATF has instructed that unless it has a barreled upper attached it is to be transferred as other.  If you look at the instructions on the 4473 there is one for block 18 that basically states any frames or receivers that are neither handguns nor long guns should be marked as other.  Since it can not be considered a rifle until a barreled upper is attached it should fall into the other category.

I would just ensure that when you get it transferred that it is marked as 'other.' If they see the stock, they may try to transfer it as a rifle.

 

Another solution would be to buy a stripped lower and build it yourself. While more complicated, it is often cheaper.

Willard is exactly right.

 

Never before configured lower, stripped, with LPK installed, or even with stock attached all good for pistol build. It's neither pistol nor rifle at that point.

Yeah, still hear about some FFLs that might do that. 

 

Ultimately though, what an FFL notates either correctly or mistakenly on 4473 is not legally definitive of classification or future configuration, so it's not like you've become a criminal just because of that.
