FN 5.7 Question

I have a fellow that would like to sell me a box of FNH191 5.7 ammo. The box is sealed and states that this ammo is armor piercing, tracer, restricted for law enforcement.

 

I have cast about the Internet to see if this ammo is legal to own and there is nothing out there except that the "restrictions" are self-imposed by FN. Anyone out there with an opinion regarding this ammo?

I think (and attempt to look up the facts about) owning armor-piercing PISTOL ammunition is restricted by federal law... If you have a PS90, I'd bet its fine.

Federal law is very specific on what is an AP round for a handgun...  SS190 rounds do not meet definition of an AP round under federal law.

 

18 U.S.C. Section 921(a)(17)(B)

 

 

(i) a projectile or projectile core which may be used in a handgun and which is constructed entirely (excluding the presence of traces of other substances) from one or a combination of tungsten alloys, steel, iron, brass, bronze, beryllium copper, or depleted uranium; or

(ii) a full jacketed projectile larger than .22 caliber designed and intended for use in a handgun and whose jacket has a weight of more than 25 percent of the total weight of the projectile.

 

SS190's have a steel penetrator and an aluminum core, you'll note that aluminum isn't listed above....  so it fails the definition of i, and the jacket on an SS190 doesn't weight more than 25% of the round, and I'm not sure it's even officially larger than a .22 caliber...

 

Either way it's not an AP round under federal law.

Federally, even true armor piercing handgun ammo is not illegal to possess. Just illegal to sell (to non govt agencies).

 

Not illegal in TN either -- just don't commit, or even attempt to commit,  any crimes with it here, as that's a separate felony charge. :)
