Cassidy’s bill would simply modify the Internal Revenue Code to replace the definition of an antique gun from one made before 1898 to one manufactured in or before 1913, the last year before World War I.


I admit I am out of touch with the thousands of federal, state and local gun laws on the books, but they need to modify the INTERNAL REVENUE CODE???!!! How many different guv'mint agencies have oversight or more importantly exert control, influence and limitations on the 2A. ATF, FBI, EPA, IRS; who else is in the act?

Actually, the definition would be modified to 'firearms over 100 years old'.  So each year, more firearms would meet the definition of 'antique'.

As yet, the bill has not yet been submitted.  Expect this one to go absolutely nowhere, though.  But, it can't hurt to contact your congresscritter and ask them to support it once we have a bill number.

How would that affect otherwise-NFA items, like say a Lewis gun? As a full-auto would it remain under NFA regulations, or as an antique, would it be open season?

I think that is already addressed with firearms like the Broomhandle Mauser (C96, right?) which sometimes came with a holster that doubled as a shoulder stock and sometimes was automatic. If I remember correctly, antique short barreled rifles or AOWs are exempt from NFA regs. Autos are still regulated, but more loosely than modern weapons.

That's what my non-expert memory recalls anyway. Been a while, though.
