They've done just that in the past, with whatever that GSG model was, with its "fake" suppressor. Hell, ATF even specifically approved that one best I remember, then changed its mind.

I'd really like to see this win.  Not just for 2A reasons or anything like that.  Just simple common sense.  Reading the text of the suit makes it clear that the ATF is wrong.
