Beretta is opening a new manufacturing facility in Tennessee, and we're welcoming them to the Volunteer State by giving away a Beretta 92a1 -the civilian version of the M9 - to one lucky 2nd Amendment supporter.

So, how are gun giveaways not considered straw man purchases?

You have to go through an FFL transfer. People and businesses give guns away all the time.

I welcome Beretta to Tennessee, but I really don't want one even if its free, they do absolutely ZERO for me.

I did sign up for it, free is free.


Dang right it is. Once it's yours, you're free to trade it for something that DOES do something for ya.

I don't care, more chances for you to win it, about the only thing free I get excited over is samples at Sam's Club  during the Christmas season.

And those aren't really free either.

Pretty cool. I would imagine a politician being part of a gun giveaway is a rare thing these days.

A straw purchase occurs when one legally purchases a firearm with the purpose to transfer it to one who is not legally permitted to purchase a firearm. So, if you buy one for a convicted felon it's a straw purchase. If you buy one and give it to your sweet mother (a non-felon)you're good to go.

Thanks. Dave explained how it goes down on a gun giveaway.   I know what a straw man purchase is  however I've never won a gun, so I didn't know if the gun was just handed to the person in the same fashion as a face to face transfer.  If it did and the gun was new, I would have thought it was a straw man.  Dave explained that the gun is transfered through an FFL to the recipient which explains it.

Another question.  If it's illegal to buy a gun with the intention of selling it and making a profit is it also illegal to win a gun with the intention of selling it and making a profit?  :shrug:

I can't site law at the moment, but it is not illegal to sell and profit from the occasional firearm. After all if you bought a pistol at market price and 10 years later decided to sell it and market price had increased $200 would you sell for less than market value?

Right, but if you purchase with the sole intent to resell for a profit, I believe it is illegal.

I'm not an attorney and I don't play one on TV but it would very difficult to prove "sole intent" if a person just keeps their mouth shut.

Nope. As long as the purpose is to enhance a collection, but not for "livelihood", it's okay. 'Course, it's not ultimately your determination. :)

Yep, giving one as a gift to any non-prohibited person is fine. Even selling it right after you buy it, and for a profit, is okay too, as long it's not for "livelihood".

 

However, highlighted part in your post is incomplete. If the person gives you the money first to go buy it for them, even if they are not a prohibited person, it's a straw purchase. It's a specific example given on 4473.
