this guy handled this well:

When this off-duty sergeant with Cook County SO is pumping gas at a convenience store, three POSs rob him at gunpoint. The sergeant distracts the lead POS with his wallet, then draws and fires, killing the robber. True to fashion, the other two flee like cowards. Great job, #wolfhunter. Glad you are safe.

Also, kudos to the mother of the dead sixteen year old robber, who came out in support of the officer. She said the officer had no choice when confronted with a gun. She also plead for the other two to surrender, and begged them to turn their lives around so they wouldn't end up like her son.

Good job. Wished he could have got all three. thumbsup.gif

And in Illinois the other Robbers will be charged with the murder of their friend.

I agree  that is was good that the officer got one of the bad guys and a shame he didn't get more but I don't think the bad guy was murdered by the police officer as mentioned above but I do think there is charges that can be brought against the other two for the death of their friend but don't think it is a murder charge but I could very well be wrong. I hope they catch the other two very fast.....................jmho

Yes, one of the bad guys was shot dead. And his friends (if they are found) will be charged with (probably) 1st degree murder.

Good to know the tables got turned...on the other hand in Cook County..

How is it that an off duty cop does this and walks away clean (as it SHOULD be), while the average person either has to go through all kinds of loops to carry, and if he did something like this, would likely lose his weapon (at least temporarily) and have a huge investigation done?

Since your question is rhetorical I’m not sure if you are trying to elicit a response or merely making a statement. It’s illegal for the average citizen to carry a gun in Illinois; same as it is in Tennessee. We have legislation proposed here to change that but I’m told by those in the know it’s impossible that it will pass in this state. Meanwhile the Illinois Supreme Court has ruled that restricting carry off your property is an infringement on your rights. So things may change there before they do here, we will have to wait and see.

The Officers at the scene can’t make a ruling in a shooting so of course his gun was taken; as it would be by any investigators doing their job. If that’s a big deal to you make sure you have a backup. The States Attorney will make a call on the shooting and the gun should be returned.

The only time I have seen a DA blatantly refuse to return a gun to someone was here. I sold a gun to a guy in another county. It was then stolen in a burglary of his home. They caught the burglar and recovered the gun. The DA had the guy come to court and testify in the trial that the gun was his and it was stolen. He contacted me because he lost his bill of sale and without it the DA would not give him the gun back. I don’t pretend to be a lawyer but it seems unprofessional to me that a prosecutor would put someone on the stand to testify to ownership of a stolen gun and then refuse to accept that testimony himself.

There will be a huge investigation in this case but it will be on finding the two guys that got away and trying them on murder charges. The video pretty clearly shows what happened with this guy. The investigation of him won’t last long; the fact that he is a cop will make little difference.

Quite frankly I'm a little surprised that off duty officers are allowed to carry in Illinois.

That is thought provoking as to what we need to do to protect ourselves in the event that firearms are stolen and recovered.  I don't think I have a single bill of sale or other documentation for a single gun that I own.  Personally I have pictures of all of my guns including good pictures of the serial numbers backed up and stored remotely in the case of theft.  I too am no lawyer but I would think that should be enough to get a gun back if it was stolen.  I actually did have a gun stolen about 10 years ago and eventually got it back all I did that time was file a police report when it was stolen with the serial number.

Unless things have changed in the last few years there is no “Off Duty” status in Illinois like there is in Tennessee. You are a Police Officer 24/7 with full Police powers anywhere within the borders of the state. Some departments have “Departmental Policy” on weapons and arrests when “off duty”, but that isn’t law.
