"Loud Music" Murder Trial in Florida

A Florida permit holder is on trial for murder after shooting into a vehicle and killing a teenager. He claims he was in fear for his life when he shot into the vehicle. If the incident went down as described in this story, it seems he may be in a world of trouble and it may hold some lessons for anyone who carries for protection.

I defense of the shooter, I also heard they wouldn't stay off his lawn.

Instigating an altercation with a unarmed 17 year old kid and then killing them claiming self defense? I would normally say he would be going to prison, but this is Florida.

As gun owners we need to keep our cool and not let trivial frustrations alter our lives and the lives of others.  Marshall survived but with injuries that will challenge him for the rest of his life.

 

Both sides of this dispute kept turning up the hostility.  As gun owners we need to remember that it's our duty to walk away if we can and not get caught up in the escalation of hostility.  If we end up using our guns in stupid situations like this we could (and should) find ourselves looking at life in prison.  Remember, the gun is there to defend your life not your ego or your pride.

According to Florida Law, he was exercising his Second Amendment right to shoot black kids. This is similar to the Texas Stand Your Ground law which states that you have a second amendment right to shoot Mexican kids.

 

All sarcasm aside, the rampant loopholes in both of these states' laws (so loved by the NRA and forum posters) could end up with the legislatures rescinding all of the Stand Your Ground laws. Our state has a reasonable and appropriate law, but we could end up losing it with the vigilantes running loose in Florida and Texas.

 

BTW, as loose as the Florida Law is, this guy could end up walking free if he gets a good lawyer.

Based on what I've read this guy is toast. Laying on the ground with a 17 year old bashing your head into the concrete is a great deal different then a 17 year old mouthing off to you from inside a vehicle. Absent the presence of a gun being displayed, this cat had no threat to him. He should have walked away. Of course the defense is going to parade a bunch of witnesses in front of the jury who all say what a great and calm guy he is, but it doesn't change the facts.

Sorry, but I cannot support this guys actions. Shooting a 17 year old kid just because he is playing music to loud it totally wrong on so many levels. I know there may be some things that are not being released to the news but the mans life was not in danger unless music can kill and turning around and walking away if the music annoyed him would have been the proper thing to do. I want to hear more because there has got to be more to this that is not being released or else the guy needs to go to prison for murder.............jmho

This sounds pretty cut and dried to me; at least based on the stories I've read.  I haven't seen in any of the stories anything that would indicate that the shooter's life was ever in danger or that he had any rational reason to believe he was in danger. As such, his claim of self defense should be a non-starter.

 

I had hear early on that the shooter claimed that the three in the SUV had a shotgun and was or had pointed it at him but apparently that was either a lie by the shooter or he imagined something that just wasn't there.

 

As armed citizens we have a higher duty to avoid conflicts when we can.

This one is gonna be interestin to watch.... If im reading the posts on the "Legal Insurrection" blog right; the only "real" witnesses to this is the defendant (...Dunn?...)...

 

I think what we are seeing is the outworking of the "on edge" black vs white thing; especially in Florida...Evidently the greater Jacksonville area is a zoo anyway... Everybody is nervous when young black (...or white...) kids start loud talkin them (...if they actually did; which i think, they probably did...) and makin threatening moves...

 

 The real tragedy of this whole debacle is that there is a kid dead... A kid who most likely said and did exactly the wrong thing at the right time....

 

There is a big lesson in this for parents is to know where your kids are, who they hang with, and that they know to keep their mouth shut; especially; it would appear, in florida.... They may just mouth off or make a threatening move to someone who well may be a genuine steely eyed killa... The lesson for kids is obvious; keep your mouth shut and don't make any stupid moves...

 

The fact is that life in these times aint a gangsta rap music video; nor a video game where ya can "rewind"... Someone got killed in this confrontation that didn't have to happen; and they aint commin back...It has become very dangerous for kids and loud mouthed adults to loud talk edgy white guys in Florida.... There seems to be a rash of self-defense shootings goin on...

 

The sad truth is that one life has been taken and a bunch of others have been altered in the saddest of ways because of this senseless encounter... I'm truly sorry for the parents left behind....

Hey I know Marshall! I went to school with him when he and his dad lived in Lewisburg. I haven't seen him in years besides on facebook. It is sad what happened. He was a great friend of mine. I used to go hang out with him at his grandmother's house in Lewisburg where he lived. We used to get a couple girls over there and have a time lol. I can't recall his dad's name but he was nice. He worked as a mortician at a funeral home in town. I remember he came to pick Marshall and I up one day in a suburbabn with a body in the back and I was a little weirded out, but we were teens back then and kinda enjoyed the "creepy" factor. The biggest factor was the shooter left. He must've been drunk, that's my guess since he was on the way back from his sone wedding.

That led to the victims to leave as well, a witness say them stop and dump a gun in the woods.
That wasn't looked into until 4 days passed. Of course it was gone then.

I believe Dunn did see a gun and feared for his life. But he left!

He got what he deserved. He was at a convenience store and confronted a car load of teens because he doesn't like thug music.

Why does there always have to be more to the story when some gun owing Jack wad does something stupid? He made a bad decision and several families will be left to suffer for years. Edited by LINKS2K
