Park Carry Bill SB 1496 goes before Committee Tuesday Jan 28th

I posted under another topic but wanted to share again with a topic title that included the specific Bill.  I apologize if this is inappropriate but everyone needs to email or contact this committee. 

 

Just sent this email to all members of the TN Judiciary Committee.  I urge everyone to do the same if you have not done so already.  This Bill is supposed to be up for consideration Tuesday, January 28th.  The email addresses to the Committee Members is listed at the bottom.

 

Distinguished Senators:

 

I ask that you support SB 1496.  

 

Tennesseans who hold a Handgun Carry Permit (HCP) have demonstrated time and time again to be law-abiding citizens posing no threat. 

 

The current situation of allowing the county or municipality to prohibit the possession of handguns in Tennessee parks has created a patchwork of laws across the state.  This patchwork creates situations where a law-abiding HCP citizen can unintentionally become a criminal.  By supporting SB 1496 this patchwork will cease to exist.

 

It has been proven time and time again that criminals do not follow gun control laws, nor most other laws, and definitely do not apply for Handgun Carry Permits.  

 

Thank you in advance for your support of SB 1496.

I already got back a robo reply from Senator Kelsey, but I got what seems like a personal e-mail from Senator Campfield (or his staff).  He said he supports our rights 100% and suggested also sending letters to major newspapers in the state.  Since he is the sponsor of the bill, I suppose he can be trusted. :)   

 

I also got a failure to deliver notice from Mark Green; anyone else have a problem with his e-mail address?

Out of Senate Judiciary (with an amendment re signs) 6-2.  Overby and Finney the only two to vote no.

Passed the first hurdle.  Sen Jud Cmte passed the bill 6-2 (Overbey and Finney voted nay).  Bill was amended to avoid a fiscal note (returned the language regarding municipalities' requirement to REPLACE any old signs prohibiting carry).  Discussion pointed out that 13-09 continues to prohibit carry in a municipal park if that park is being used by a board of education for a 'school event', regardless of this bill.

Finney basically upheld governor's stated objection that decision should remain at local level.

Overbey objected, saying he supported 2nd Amendment rights, but he felt local municipalities should be able to post just like a property owner could.  He likened it to "Federalism on a state scale".

Campfield countered that argument noting that this is a constitutional issue where the legislature is clearly given the authority to regulate, and no option to pass that option down.

The Senate version can go to the floor for vote whenever the calendar committee decides to send it.  The House counterpart has yet to be calendered for consideration by the Civil Justice Subcommittee.  From there, it will then go to the full CJ Cmte, and eventually to the House floor.

I watched the video of the Senate committee. I was especially caught by the Governor's representative's statement that Haslam opposed the bill. (wow are any of us surprised by this?).

Given that he has now come out publically that he (Haslam) opposes this, I fell it is quite possible that he would veto it if it makes it to his desk. If that happens, given the "no gun bills" attitude of the leadership in the General Assmebly, I doubt there would be any support for a veto override.

I think there is a good chance this makes it to his desk, and if he vetoes, it gets overridden.  Remember all it takes is the same number of votes to override that it took to pass it.

 

Sen. Stevens' statements lead me to believe there has been a paradigm shift, it is election year after all. His statements about the Constitutionality of the bill gives me hope.

 

Maggartize is a phrase that has meaning now. The governor, Lt. Governor and Speaker of the House supporting MS Maggart did not save her hinney, I think that there is a chance that standing on principal may appear to be a survival tactic this year...

supposedly Haslam feels that local gov. has a feel for what is best for its constituents.  I think the governor needs to remember that these are the peoples' park, not the city's.  Also I watched Mr. Campfield handle this Bill and the questions with a cool, logical, and knowledgeable manner.  I'm glad I voted for him and will do so again.

Not really.....the liberal media always likes to highlight some of Stacey's  uh, uh,  lighter moments.  I like him because he will act independently and will take a stance.  Certainly not part of the establishment.  Plus, he is a strong 2nd Amendment guy.
