There is no speculation. Obama's man on the ground said it. I heard him say it and apparently so did the news people. We now have 14 people deciding whether other mayors, corporations, private businesses, and one other thing I left out that he said, farmers get funding or not depending on whether they can comply with these new regulations. He specifically said they would be scouring" bills to look for possible compliance issues and would withhold funding based on that ability to comply. But only those projects. Obama's Democrat team and his token Republican will be deciding for everyone else. There is no speculation. This is the equivalent of line item veto power that only Congress can approve and has withheld from presidents for 237 year's.

I guess we will see how this actually plays out in the SCOTUS because, if discretionary powers were already allocated to funds provided through EPA, while I may not agree, I am not sure how much of a change this is beyond setting a clear direction for how that discretion shall be applied. If, however, this is a clear expansion of EPAs powers beyond what has been legally granted, I am not sure if this is much of a change beyond direction setting.
