Drone Hunting Season

Lol I saw the ramp up for this a week or so ago, that peta or whoever was selling drones to their people to spy on unethical hunters.  And I predicted this would be the result.  And, LOL, those drones are expensive.

says well over 300 bucks a pop, duh.

 

Normally I would frown on the destruction of private property but spying on other people without a warrant is also a crime so I say blast the things until the price becomes too high for this program to continue.

Does anyone know specifically what "private property rights" a person has in the airspace over his/her property?

 

I know, for example, that it is illegal for me to discharge a firearm from my home because I live in a "city" and it's prohibited. But assuming I could and/or lived out in the county where it was legal; what are my rights with regards to someone "spying" on me with a "drone" like this?

 

EDIT: I guess there is no answer, yet, to my question above and this is something that will likely just have to be worked out in the courts. I do understand the concept that no one has an expectation of privacy when out "in public" but I don't consider standing in my back yard or hunting in my own woods/field (if I had one) to be "out in public"; especially if it takes extraordinary measure like an aerial drone to observe me!

There isn't a specific legal precedent set.  Though generally courts have upheld that below 500ft is the property owners since anything above is navigable space controlled by the FAA.  Obviously the drone was well below the commonly accepted threshold, or that guy is wicked good with a shotty.

Effective range of a shotgun is limited but with 3.5" goose loads, its well over 500ft.

OK, I have officially declared my hunting property and my yard a "No Drone Fly Zone". Let this serve as official warning that all drones that enter restricted airspace will be shot down! Could you imagine having to put up signs like that on your property along with "no hunting" signs?

About 20 years ago I read that you have rights to the tallest tree or point on your property. It was an article where someone living close to a small airport was trying to sue because airplanes flying over his house.
