Lets see, he was drunk....BUT....he was on his own property and the guy punched him several times in the face first.

 

So, 99.9999999999% of us agree that alcohol and guns don't mix

 

BUT ON THE OTHER HAND

 

He didn't pull his gun until he was attacked, His girlfriends 's ex husband (who did the punching) and HIS wife (Or was it his ex wife who is girlfriend of man who was punched?) showed up on his property. And she (the ex wifes ex husbands wife) was filming, so she was obviously hoping to catch something....and did.

 

(I think thats how it went)

 

Either way. You drinking, someone shows up on your property, words are exchanged (Your not friends to begin with), and he nails you 2 or 3 times in the head, do you pull out your firearm?

 

I know what my opinion is. The Police and District Attorney already made theirs.

He shouldn't have pulled the gun. He should have took those little sissy girl punches like a man and called the cops and had the attacker arrested on domestic assault charges.

 

There was no deadly force with those girl punches. He definitely isn't MMA fighter or something.

 

I think they're going to make an example out of this clown.

 

As for the camera wilding woman, I think she was wanting to rev this guy up and catch something on video to screw him over with since they were having issues between child custody or whatever. What she got instead was a bullet in the lung by her new lover on accident. A clear case of if you go looking for trouble, you're going to eventually find it.

I'd say he started it right, yeah pull the gun to take full control of the situation...given the other guy has some sense. But I missed what caused him to drop it and let the other guy get control of it. Guess he fell when he kicked at the camera. Should have just stayed where he was and ADSed them while they left or police were called. I'd like to know what his BAC was before I pass judgment on the firearms w/alcohol call though since it was in a holster and not put away. Then again it is private property and I don't think big bro should get a say in that.

Unfortunately he was already in the wrong simply by being even slightly intoxicated and carrying (not grabbing from a dresser, nightstand, etc) a loaded weapon. Strike one legally. I agree with JohnC, it wasn't like the guy was doing the ground and pound on him....he could barely reach his face to hit him. Strike two legally. Even though the other guy got charged with "negligent assault" (whatever that may be, sounds like reckless endangerment with accidental injury to me) the blame is still going to be directed to the guy who brought the weapon out of the holster and into the equation. This is why untrained, irresponsible people don't need to pull guns. If he has a HCP or CCW, he should NOT have been carrying his gun and knows it. Simply stated, all of this could have been avoided. The dumb woman filming was obviously antagonizing the situation, and it could be argued that the guy wearing the weapon was planning the altercation and thus armed himself. I'm just playing devil's advocate here...

I think the takeaway here is that guns are for saving life and limb, and this incident does not fit the criteria IMO.

This has nothing to do with Castle Doctrine the homeowner invited them there; it was simple self-defense. The homeowner had a right to pull a gun when the other guy attacked him. But that justification ended when the attacker ran and the homeowner pursed him.
