You can carry in a place that serves alcohol as long as you don't consume alcohol.  You cannot carry in a place if you consume alcohol while there.

 

However, you can carry before and after going into that establishment as long as you are not under the influence.

 

I go out for dinner with friends almost every week. I'll leave my gun in the car, go in, have dinner and a beer, come out, and I usually leave my gun handy on the passenger seat under a towel. It's very rare that I would stop or get out of the car again, but if I do, I'm carrying my gun. The only place I might stop is our local rural gas station and half the patrons there are carrying too.

 

I'm not going to be drunk with one beer. I'm not out at 3am, like the guy in the article. I'm usually home by 9PM.

So you can't carry in a place that sells alcohol at all? Even if it's a family restaurant? Or somewhere that alcohol isn't their primary draw?

 

As long as it's not posted, you can carry in the fanciest most expensive purveyor of liquor by the drink in the state to the scuzziest beer dive in the state.

 

But it's a Class A misdemeanor to take a sip inside if you have a heater.

 

If you're caught "under the influence" elsewhere, call is up to the cop/judge whether you really are or not, and no, they don't have to give you an alcohol test.

 

Class A 'meanor for that, too.

 

If you're both under the influence AND in a place that serves alcohol with a heater, whether you got under the influence in that place or not, you also lose your permit for three years.

 

AND, seems to me you could be charged with TWO counts of Class A if you're imbibing in the place AND are under the influence.
