Is it ok to carry in a private day car center when picking up children? Can they classified as a school?

I would probably ask them if they are a school or not. If its run out of someone's home I wouldn't carry without permission, but that's just me and its a matter of respecting the property owner.

It is a stand alone center in a commercial area.

Schools are licensed by the department of education in TN, except in some very rare cases of certain types of religious schools.  A Day Care is not licensed as a school and therefore doesn't meet the requirements of a school under the carry laws.

 

You should be fine to carry there unless posted under 39-17-1359, or some other form of posting....  The no carry law in schools has ever specific posting requirements, you would have noticed the signs already because they have to be a certain size, not little gun buster door stickers.

And specific wording:

 

" Each chief administrator of a public or private school shall display in prominent locations about the school a sign, at least six inches (6'') high and fourteen inches (14'') wide, stating:

      FELONY. STATE LAW PRESCRIBES A MAXIMUM PENALTY OF SIX (6) YEARS IMPRISONMENT AND A FINE NOT TO EXCEED THREE THOUSAND DOLLARS ($3,000) FOR CARRYING WEAPONS ON SCHOOL PROPERTY."

 

However, just like the meetings and parks statutes, there's nothing in there that says you can't be convicted for non-conforming signage, or even no signage at all.

I stay away from day care centers,  Toddlers with guns frighten me.

Well with the new parking lot bill, it allows carry in your car (as long as it's not handled and out of view) for all reasons now.  Not just dropping off or picking up passengers.

 

So a teacher can now store a firearm in their car during work without breaking the law.

I'm glad to see some clarification. I have been operating under the "concealed means concealed" line of thought, when picking up my son from day care.
