Transfer of a Class 3 weapon after death?

What would my family have to do to transfer a Class 3 weapon(SBR) when I die?

If your item is in a trust, it should convey without probate or anything like that...your trust should have of course beneficiary information that shows who gets it.

 

If it's in your personal name and you/they want family to keep it, they'll have to fill out a Form 5.  No tax would be necessary for heirs but they would still have to get prints, signoff, pictures, approvals, etc...

 

If they choose to sell it or transfer it out, your probate/estate coordinator can facilitate a Form 4 tax paid ($200) transfer to whomever  - dealer or individual.

 

Or, they can simply put a 16" or longer barrel back on it and sell it as any other title 1 weapon... it would no longer be a SBR.... probably the easiest, if not going the heir route. In my opinion Form 1 SBRs have really no extra monetary value in resale unless they are factory SBRs ... reason being anyone can still make their own so unless there's a compelling reason (usually price and/or configuration is exactly what user wants) it's much easier to sell as a title 1 and just simply have the SBR removed from the registry... letting ATF know via a written letter is their request but currently NOT a requirement.

Sounds like the easiest thing to do is to put the barrel extension.Next ,I guess would be the Form 5.Dont really know about a Trust ,sounds like spending more money for nothing(I'm not really up on that stuff though). Thanks for the information .
