New York Sheriffs Refuse to Enforce Strict Gun Control

Recommended Posts

Folks may think I an not the sharpest knife in the drawer but I just learned back about a year ago that the Sheriff in what ever county they serve in is by law one of the most powerful law enforcement officers in the state which they preside in. They even have more authority than the state Troopers and in Tennessee they have more authority in their home county the the TBI does. Reason for that kind of authority is because the Sheriff is an elected official by the people of that county. I guess that is why all the sheriffs across the country are telling these Governors to take their laws and stick um. When they take their oath they take and oath to serve the people of that county and that is what most of them are doing...........jmho

I wonder how long it'll be before these sheriffs are removed... for the safety of the people, or the shilren, or whatever malarkey they come up with. Ah well, it's nice to know there are a few decent people left in New Yuck.

just about every county has passed resolution against the "safe act "(i am in st.lawrence  for at least a few more weeks) i dont know a single person who supports the safe act . i have however been reminded about the new laws countless times by leo's at the range.

The incredulous Andrew Cuomo won't be running for president over it. Too bad. :D He deserves this.

It's good to hear about some sane people in that state. The ones running it are mostly insane.

Bersaguy's post (...#3...) above pretty well sums up the sheriff's responsibility and police power thing.  I think (....i dont know for sure...) that the office of sheriff in each county of a state is a "constitutional one"; and he is duly elected by the citizenry, and not appointed by some political hack.... I think he is, in fact, the chief law enforcement officer of the county that elected him, and his police power reaches all over that county, even into the cities and towns in the county.

Havin said that, i think there are "agreements" between the county and the municipalities therein where the "police" may be the lead in law enforcement.  Hopefully, our buddies in the legal profession who are students of this kind of stuff will fill in the details.

The bottom line is, it is very significant, indeed, that county sheriffs are refusing to enforce laws that they deem are unconstitutional at the state and federal level.... Very significant, indeed....

PS-- Got interested and lifted this from the sheriffs association website: http://www.sheriffs.org/sites/default/files/tb/The_Elected_Office_of_Sheriff_-_An_Executive_Summary.pdf
