Maybe they're just tired of dicking around with this Einstein. They can use our tax dollars to drag this thing out and he has to pony up. Might be the only real pain they can inflict on him.

 

I agree. He needs to stop this crap right now. Taking him into the back room and beating him with a rubber hose would accomplish the same thing. But, they can't do that anymore.

I'm sure they are tired of him, but I'm not fond of the .gov flexing their muscle to prove a point, all while it appears he didn't break any laws.

 

He broke some of my laws. Let 'em flex. As ineffective as the system can be, if they can stop Lenny from doing his stupid, dangerous crap, then more power to them.

Channel 5 this morning said that Embody represented himself in court yesterday, and told the Judge the Police had NO RIGHT to arrest him. The Judge said "yes they did", and bound him over to the Grand Jury!
 
So much for that huh?

His antics are going to cost us all with stiffer or more ridiculous laws.

You know, I'll bet that if a group of concerned gun owners got together and had a serious meeting with him, there would never be anyone prosecuted.

Believe this is my first ever comment on the asshat, but this bothers me:

 

 

Mondelli castigated Embody several times during hearing, once saying, "I understand you have a right to exercise your constitutional rights, but frankly, the way you went about exercising your constitutional rights was completely stupid."

There's no doubt he's made some choice that I'm not likely to duplicate, but that doesn't negate or justify the .gov's abuse of powers, in my humble opinion.

I've known of more than a few people who've pissed me off by doing something I'd consider stupid, but I wouldn't want the .gov resorting to the same shady tactics that could possibly be used against me for little more than doing something that someone else doesn't agree with. They have too much power as it is, and being OK with the abuse of said power for any reason should never be acceptable, in my humble opinion.

I just can't agree. The guy just flat out threatened people in downtown Nashville, just so he could prove that he was abused, and get his payoff. So... let him prove it. HE is abusing the letter of the law. I'm not about to get pissed at the government for playing the same game in return. So, let's see who wins. It's Lenny's game. He brought it.

I doubt it. After all Lennie knows better than any of us. His posts here and elsewhere prove that.

I hope that he learns from this enough to get his own attorney.  A decent respected attorney and a conversation with the DA along with proof the suppressor was legal would likely have resulted in the whole thing being dropped.

 

A probable cause hearing is just that.  The court has no obligation to hear any evidence not directly related to the stop and the arrest itself.  Evidence of innocence is a separate thing and not heard in probable cause hearings.

I listened to the audio (thanks Garufa) and its clear the the police were scared there was a north Hollywood shooting or other active shooter event about to happen. Add Mr Embody's refusal to say anything (his right of course) the police were left with a situation of a man walking around downtown nashville wearing body armor and carrying a case shaped like a rifle.

What would mr embody like the police to do next time they see someone like him? It perhaps a man wearing a ski mask holding a cloth bag walking out of a bank?

Out of curiosity, how is it legal for local or state LEO to enforce Federal NFA laws? Isn't this similar to the argument that the SCOTUS recently ruled against Arizona for enforcing Federal immigration law?

 

Possession of unlicensed full auto, SBR, SBS, or suppressor is statutory violation under TN law also.

 

New headline on Kwik's FFL site:

 

"Sorry, I can't accept transfers due to a possible pending indictment."

 

I listened to whole audio while doing other stuff, and it's pretty obvious the judge is giving him as much grief as he can. Didn't accept any of the federal documents because they weren't certified, said could have been made up, etc. Final statement, "I don't think Mr. Embody is crazy, I think he's stupid."

 

That sort of sums up Kwik's history -- with the arguable exception of getting the archaic and unenforced ordinance removed in Belle Meade, none of his antics have in any way been helpful in expanding firearm rights in this state, and if anything contribute to more restriction.

He brought this whole thing on him self. All he had to do was answer a few simple questions about his weapon and be on his way. But he refused, and left officers no choice but to do what he did. I also think he will have a hard time convincing the judge that the gun was in a locked case.

That's the problem now with our commie government. They don't view any American gun owner as a typical gun owner, and we're just gonna cave in to these freedom grabbers until we no longer have guns.

lenny's not caving in.  At least not in the traditional sense.  Its more like he set dynamite at the entrance to the cave walked into it and sealed himself shut.     He's choosing not to communicate with the DA to get it dropped.  He's choosing to continue down a frivolous path that may result in serious consequences and he's using our tax dollars to do it. 

 

On another note, you can not really call the current government communist not even really socialist, even the farthest leaning leftist is not truly a communist or a socialist in that both political ideologies require advocating that every able bodied member of society works in order to meet the the insane levels of production necessary to permit either.

 

Also worth of noting is that for either to be successful in a change in the government an armed working class is critical.

He didn't care about this going to the grand jury.  That's where he wants it to.  And probably on to a jury trial. I just hope he gets a Lawyer for that. A bad verdict there might not be a good thing for us.  Those now famous words of Red, on That 70's Show, serve as an apt description of Kwik; Dumbass!

I believe you can most certainly call or identify the current occupant in the WH, and the servile Dumacrats as nothing more than communists/socialists as evidenced by their trampling the Constitution, and by their liberty and freedom grabbing efforts everyday. When they are through destroying our capitalistic Constitutional Repbulic, you and every able-bodied person will be working under the heavy chains of bondage.

As for a armed working class for the commies to be successful, they've already achieved that goal by gaining control of the government while the people were asleep or apathetic to what was going on with their government. The commies have the TSA, DHS, BATFE, and other agencies armed and ready to come and take your guns away from you when the political climate is ready. Full government tyranny is accomplished when the people become disarmed, and that's the ultimate goal of these commies in office now.

We may not be in the full and complete stages of communism yet, but there is ample evidence that our nation has embraced it and ready to implement it. If the people allow further infringement of the Constitution and the 2nd Amendement, you can get ready to be a good comrade or a dead patriot.

I may be wrong but I believe if you represent yourself you can not appeal on the grounds that your attorney was an idiot.
