Clarification of Overall Length?

I know overall length has to be 26"

 

However I've seen some people refer to that as the stock fully extended length.  Does anyone have a definite word of law or letter from the ATF to confirm one way or the other?

OAL is measured with a fully extended stock. That was decided by a court case involving some M-1s in paratrooper stocks back in the 70s. This only applies to the federal government, some states (CA, MI for example) dictate that OAL is measured in the fully collapsed/ folded position.

We also have state law on it. It doesn’t address the collapsible stock issue, so you would need clarification on that also.

Since it isn’t stated in the law you run the risk of arrest and trial if it is less than 26” collapsed.

Note that federally,  if needed to reach legal overall length, a muzzle device must be permanently affixed, in same manner as it is to count for just barrel length, too.

Neither does federal law. It's a ruling, not in the USC or CFR. Neither is muzzle device regarding barrel length or overall length either. 

 

Never seen anything to the contrary that TN defaults to ATF code/rulings on all NFA matters. Some states, however, specifically mention folding stocks as not counting under their own code. Some don't allow collapsible stocks at all. Some states require muzzle devices to be permanent on any barrel. Etc.
