I'm guessing the same people who would be willing to spend a couple thousand in legal costs (not to mention missing work) to do this...

Oh, I'd be willing, but, I'm pretty much a SOB about anything and everything to do with child custody and divorce.

ETA:

Losing a $500 pistol is one thing. Getting a bad OP can cause you to lose ALL your guns for ever. Just a slightly different stake.

If we could take the judges to the cleaners for issuing OP's without proof they just might get a little gun shy and stop the blasted vending machine approach we have now.

When you turn in a DL from another state to get one in the state your in that state notifies the former state you gave up your old license to get a new one in the state you moved too.....make sense? Thats how TNDMV found out he moved.....

I wonder what kind of shape his 1911 is going to be in when he gets it back or if he ever gets it back.....

But it wasn't "unlawfully" seized or confiscated.

Didn't say it was or wasn't, just thought that some of the info posted could be relevant or least interesting to those following this.

The fact that it's taking so long to get the gun back doesn't really come as a huge surprise to me.

I had a gun stolen from my home in Overton County (Livingston, Tn), and it took over a year to get it back.

Not only was the gun stolen from my home, but so was every piece of electronic equipment (TV's, VCRs, DVD players, Game systems, everything), tools, telephones, and kids unopened Christmas gifts. The scumbags even stole our 10 year old junky vacuum cleaner. It was my ex-girlfriends meth-head brother who stole everything while we were out of town for the Christmas holiday.

The Overton County Sheriff's Office had the gun (and eveything else that was stolen) in their possession just a few days after being stolen. They made records of all the items, then called us to pick up our belongings. After loading everything up in our vehicles, I asked about my the gun my father had given me. I was informed that they could not give it back to me right then. I would have to wait a week or so. I didn't really get all that worked up over it.

Well, after a full year of being without the gun my father had given me, "worked up" was beginning to be an understatement. I was quickly becoming quite pi$$ed. After bitching and moaning for several more weeks, I was finally able to come get it.

I'm not going to go into all the details, but I know someone in the Bowling Green KY area who also had a gun stolen. It's been nearly 7 years, and he still doesn't have the gun in his possession. It's a real shame.

After reading his account, in full, I don't really see where the Gallatin PD is at fault for anything. Would I be pissed? Sure. But is the PD in the wrong? No.

The DMV ****** up.

I hope he gets his SA 1911 back in a timely manner (read: soon), but it sounds as if the PD is going to do everything by the book, to the letter. Background check, reports signed off, etc etc. Crappy, but that's their prerogative.

If anyone owes ColtCCO an apology, it's the DMV... not the PD. By his own testimony, it sounds as if the police officers that detained him acted in a professional manner and courteous (the officer even showed him the NICS on his computer and apologized for having to do his job). The department recognized that they have his weapon, and that they must return it, but that they are awaiting completion of the case/issue.

It could have been a lot worse. Am I missing something? :koolaid:

It doesn't take days to get a check done on a weapon. We do it every time we take one in on trade. I think he has reason to be ticked off at both.

but they arent running just a stolen ck, they are running a complete trace... and you know how long that can take!

Yea.. every time I call MJPD and give them a serial number, it takes about 30 seconds for them to run it.

An NCIC check is different than a ATF gun trace. There's a difference. A "Check" through a PD or dispatch is simply searching a database for "wants" or "hits" on a serial number.

The pistol wasn't used in a crime, no one was shot with it.

I think they are just being supreme AH's!:lol::D:mad:

I would for sure be contacting one of the more gun friendly congressmen or a state senators. This just amounts to plain and simple harassment and abuse.

The trace is probably more CYA than anything else. I hope this gent gets his 1911 back sooner than later.

A police officer can legally detain you for 48 hrs without filing charges against you. They can likewise run a complete trace on a firearm and be within their rights to do so.

Why would they do this?

Because you shot your mouth off at them instead of being polite and playing nice. The lesson here is to be respectful, courteous and professional and that the LEO will most likely return the favor.

I ran my mouth to a cop once after he pulled me over for what I perceived as a complete BS reason. He gave me a nice $100 ticket for my trouble. When I bitched about it to my retired cop grandfather, he told me "Looks like you talked yourself into a ticket."

I was 17. I learned my lesson early. :P

The cops don't need me taking up for them. They're pretty capable of handling themselves. After all, who left with the gun in this case?

So, as long as the cops got to take his gun, then taking his gun was appropriate? That's some fine logic.
