I thought the point of an arrest was to get people to talk and confess?

Boy Who Refused to Take Off NRA Shirt Facing Possibility of 1 Year in Jail

Suspended and arrested after refusing to change his NRA shirt. Today, 14-year-old Jared Marcum appeared before a judge and was officially charged with obstructing an officer.

The arresting officer from the Logan City Police Department, James Adkins, claims that when Jared refused to stop talking during the arrest and that hindered his ability to do his job, hence, the obstruction charge.

Hard to believe this is happening in a state who's state motto is " Mountaineers are ALWAYS FREE".

They're trying to make an example of him but if the NRA gets involved, and they probably will, this will more than likely be thrown out BUT we'll just have to wait and see. I say here-here for the young man for doing nothing wrong except being a patriot.

I'd wager the kid's mouth is what got him busted and expect nothing from the NRA.

This is probably true!

I don't know what his high school dress code is, but here, high schoolers cannot wear sleevless tee shirts exposing their armpits. I think that may have had more to do with it than it being the NRA logo on it. Sometimes it's best to just comply (remove the shirt) then take up the fight at a later date.

We'll see how this turns out...

Yeah. I'm betting it's the classic arguing with a cop on the side of the road. Still, the front lines for the war on guns is in our schools. How did the cops wind up getting involved to begin with?

Here's a good article from Hot Air that covers the story pretty thoroughly: http://hotair.com/archives/2013/04/21/8th-grader-suspended-arrested-for-wearing-nra-shirt/

My guess is that if the Logan County School system doesnt have a dress code that addresses this (...they dont, i checked, you can google logan county wv school system and find it...); they are in big trouble.   There are plenty of pro bono law groups that could take this up if the kids nose is clean, and he is a reasonable, responsible, student and citizen.  If he wuz respectful, there wuz a camera recording it all, and he didn't do anything out of the way; the school clowns are inbig trouble.

Check this out:  http://www.firstamendmentschools.org/freedoms/faq.aspx?id=12991

Logan county, WV is an old time democrat stronghold; but they like guns there too.  This one will be interesting to watch.

What I read said it was exactly the opposite.  The kid would not answer any of the officers questions.  The cop said his unwillingness to answer his questions is what obstructed his investigation.

Refusal to incriminate himself = criminal offense? Just saw something on Drudge Report about something like that too, making it "incriminating" to not incriminate yourself by not talking.

So much for the 5th...

I just checked Drudge to find a link, it wasn't there so it must had been on another news site that another story on Drudge linked back to, *sigh* if I come across it again I'll post a link to it.

Nope, much like every other law on the books ... it only applies to us piss-ant peasants, not our supreme ruling class elites.

If a NRA shirt is not acceptable then why do all the idiots at walmart walking around with foul and obscene garbage on their shirts not get arrested. I find someone with f#%k you on their shirt actually offensive. And I have seen a lot worse.

Your "feelings" only matter if you are a leftist, homosexual, minority and or a woman (but not a pro-life, conservative &/or Christian one).

If you fall into one of the above catagories your "feelings" trump everything else, including common sense, the Constitution & any/all reason.

Walmart is not a school.  Unless someone complains to Walmart management nothing is going to happen and likely nothing will happen even if you complain because Walmart isn't going to want to get in the middle of it.

Most schools have a dress code and even if a school doesn't have a dress code that specifically addresses this issue I bet most courts will uphold the power of the school to set its own standards and enforce them.

All that said, if this kid not cooperating with this LEO is what got him arrested THAT bothers me a lot more than any stupid T-shirt....I've seen no law that tells me I EVERY have to answer a cop's questions and if I'm not required to do so then I shouldn't be arrested for not doing something I'm not obligated to do.

It's not against Walmarts dress code...

Wow, am I missing something?

1) the school has no rule against wearing clothing depicting firearms?
2) a teacher takes exception to the kid's shirt and makes unjustified demands?
3) the kid refuses, resulting in the police being called?
4) the cop arrests the kid for not answering his questions?

Good for this young man knowing the rules and standing up to oppression!

I reread several articles and can't find who actually called the police. I assume it was the Fascist teacher. If it was the school admins that called the police, that would seem to indicate they agreed with the teacher's assessment and don't know their own rules. Even if the kid got loud back at the teacher, that seems like a huge overreaction.
