ANDREW WELSH-HUGGINS (AP) - Associated Press Writer COLUMBUS, Ohio A death row inmate scheduled for execution says he's too fat to be put to death, claiming executioners would have trouble finding his veins and that his weight could diminish the effectiveness of one of the lethal injection drugs. Lawyers for Richard Cooey argue in a federal lawsuit that Cooey—5-feet-7 and 267 pounds—had poor veins when he faced execution five years ago and the problem has been worsened by weight gain.

The lawsuit, filed Friday in federal court, also says prison officials have had difficulty drawing blood from Cooey for medical procedures.

Cooey, 41, is sentenced to die for raping and murdering two young women in 1986. His execution is scheduled for Oct. 14.

His attorneys say a drug he is taking for migraine headaches could affect the execution process. The drug Topamax, a type of seizure medication, may have created a resistance to thiopental, the drug used to put inmates to sleep before two other lethal drugs are administered, Dr. Mark Heath, a physician hired by the Ohio Public Defender's Office, said in documents filed with the court.

Heath says Cooey's weight, combined with the potential drug resistance, increases the risk he would not be properly anesthetized.

"All of the experts agree if the first drug doesn't work, the execution is going to be excruciating," Cooey's public defender, Kelly Culshaw Schneider, said Monday.

Prison system spokeswoman Andrea Carson and Jim Gravelle, a spokesman for the Ohio Attorney General's Office, both said Monday they hadn't seen the lawsuit and couldn't comment.

Last year, Carson cited the obesity of condemned inmate Christopher Newton as one of the reasons prison officials had difficulty accessing his veins before his execution. Newton was 6 feet tall and weighed 265 pounds.

Two years ago, convicted killer Jeffrey Lundgren was put to death after a federal appeals court rejected his claim that he was at greater risk of experiencing pain and suffering because he was overweight and diabetic.

shoot the prick. Either go back the firing squad or public hangings. I dont understand why they try to be so compashionate to these monsters.

The firing squad is still legal in 3 states. Should be all of them IMO.

I bet his lawyers (which I'm sure are tax-payer funded) would say the restraints wouldn't fit or would be too tight...might be uncomfortable...before they fry his fat ass :up:

if a heroin addict can find veins in their foot, I bet a team of doctors could find one in this guy.....that or just stop F'ing eating so much!

I say use the drugs to kill him, but give the father of either one of those girls a bat to knock him out with first...problem solved.

Having a daughter myself I would have to say that this is the best idea. Simple and costs about what $20.00?

I bet there is more than one person in the US who would volunteer to make a custom chair for this POS free of charge.

I wonder if he was concerned about how much pain those girls were in when he raped and killed them.

Whats sad is that they waited until 2008 to fry someone that should have been put down in 1986.

They really should just take 'em out back and shoot them after their trial.

ain't that a bitch. I would think some pain might be a good start for this waste product.

And how does one get fat in prison anyway? I would think prison life would be the equivilant of being forced through Jenny Craig and Weight Watchers with a little anal sex thrown in.

That guy is just a little twirp. I am 6'-7' and 320 pounds,down from 360 not to long ago. The nurse didn't seem to have any problems finding a vein to stab on me this morning. I'll be she would go stick him for free!

I think the best answer would be to use a large rifle caliber since he is so worried about his weight. Nurse would probably volunteer for that one too!

The drugs are usually dosed as "milligrams per killigrams" anyway, which means the heavier you are the more drug that you receive. Thiopental is dosed this way when using it to induce anesthesia, which is what they do when they put these people to death. It's considered bad practice to give a one-size-fits-all dose to everyone. In addition, many drugs are based on ideal body weight, which is much less than actual weight with obese people. The lawyers should have done some research before they presented this argument.
