Illinois House and Senate passes CCW!

I'm shocked. It passed with a big enough majority that the Governor can't veto it. The qualifications are rough but it's still an amazing step in the right direction.

To qualify, an applicant must:

• Have a valid Firearm Owners Identification card
• Be at least 21 years old
• Complete the required 16 hours of firearms training
• Not have any convictions for violent misdemeanors in the past five years
• Not have two or more DUI convictions in the past five years

Also required with the application is a fingerprint and background check conducted by the state police, who must approve or deny the application within 90 days. The cost of a concealed-carry license is $150, and the licenses are valid for five years.

While HB 183 gives a person the right to carry a concealed handgun, there are restrictions as to where a gun may be carried. These include:

• Schools
• Preschools and day-care centers
• Playgrounds
• Parks (except bike paths or trails)
• Cook County Forest Preserve
• Colleges and universities
• Government buildings
• Correctional facilities
• Medical facilities
• Public transportation
• Public gatherings (although a licensee may pass through to reach their home, workplace or vehicle)
• Bars, casinos and race tracks
• Libraries, museums, zoos and amusement parks
• Stadiums
• Special events where alcohol is served
• Places prohibited by federal law

It really is, and I never thought if enacted, it would be on shall issue basis as it is.

 

Hopefully a stepping stone to further loosening restrictions, though I might say the same for here. At least seems places can't criminalize permit holders with a frigging sign.

 

I think we should all send Rahm a message of thanks, as surely this couldn't have been passed without Chicago's support, eh? :) :)

From reading about its progress on another forums, seems it's bullet proof, state preempted.

 

I think Chicago can still have its onerous stipulations about actually owning a handgun in the first place though, don't believe anything like that was made void.

Sen. Doug Jackson (Democrat from Dickson) was one of the most ardent supporters of firearms issues while he was in office, as was Rep. Ben West.  Republicans do not have a lock on supporting our firearms Rights.

It is now being reported on another forum that out of state visitors may carry while in their vehicles. So for anyone wishing to pass through the state you can keep a loaded gun in your vehicle. 

 

I have not confirmed this yet but it's apparently part of the bill.

This is great news for all the people that worked so hard. But is funny that the deciding factor came from a very unlikely source; the 7th Circuit Court. The 7th has always ruled that the 2nd was not an individual right, but fell in line once the SCOTUS ruled it is.

This legislation also appears to make a car a “Safe Harbor”. A secured gun could be kept in a car even if it’s parked in a prohibited place. Unless if by “secured” they mean unloaded; that’s always been legal other than Chicago.

We've been going to IL for years on business trips.  We are always in rural areas and I always scratched my head when everyone we did business with were avid gun owners that seemed to not even know that there were very many restrictions on guns.  They knew they had to have a FOID to purchase ammo but seemed oblivious to any other restrictions.  I'm glad that someone finally woke up although I expect the other shoe to drop - restrictions that aren't obvious.  I certainly hope not but after watching the shenanigans from northern Illinois (my wife's father was an engineer at Caterpillar in Joliet and we were married there) I tend to be cynical where Illinois politicians are concerned.

I didn't have any expectations, I was only trying to show the folks crowing about what a great day it is for gun rights in IL how wrong they were. Chicago has that state fucked up like a football bat and just like NYC, DC or LA, if somebody nuked it I wouldn't shed a single tear. Edited June 1, 2013 by Chucktshoes

Too bad he didn't convert to Republican. He could have straightened out our Republican legislature.

I agree this is a step in the right direction.   What's up with two of the restrictions listed below?  How do they enforce these?   The second one is very vague.

JayC, you know yourself that is not what I said. I said that the Feds can’t say everyone can strap on a gun and walk down the street without restriction; some states would refuse; I would bet Tennessee would be one of them.

The SCOTUS has not specifically ruled on the “bear arms”; leaving it up to the states and Federal Districts but have indicated States Rights. They will eventually have to specifically address it if there is disagreement between the Federal Districts. How long will it take? Well it took over 50 years for the court to acknowledge and individual right to own.
