Are there any cities in TN that prohibit pepper spray?

The TN state law apparently doesn't prohibit chemical spray but are there any local governments that do? Just want to know if I need to be careful about where I carry it...

Tennessee: Legal, no restrictions.

 

Here is a link to laws in all 50 States. It is legal in all 50 States but some cities have restrictions. Link is sort of like concealcarry.org for pepper spray. the site is peppereyes and sells the stuff, but does say if you have any questions you should also check with local authorities. There may be some local restrictions.

I notice there are several Firearms dealers in TN who also specialize in Non Lethal weapons, bet they would know.  Seems Sportsmans Supply and Services in Chattanooga is one of them.

Good resources, thanks! It's too bad cities can apparently supersede the state on this. Makes for confusing laws to try and follow. Glad this is no longer the case with knives now that the new bill was signed!

Ive never heard of a tennessee muncipality putting restrictions on carrying oc spray. The generic model codes that the state advisory service provides that many cities in the state use doesnt have anything in regrds to oc spray.

I really don't know what a city can do if your breaking a city ordinance. Fine you? That is about all they can do.

I always wondered what the rule was for having OC while drinking. I've done it but never researched it. Figured it wouldn't be an issue unless I used it.

Fine and/or jail.

 

Most offenses are equivalent of state Class C misdemeanors ($50 and/or 30 days).  Knoxville has some higher fines involved for various offenses but AFAIK max jail time on any are 30 days. If any property damage or labor costs are incurred as a result of the misdemeanor, can also be assessed those, too.

 

I imagine most cities in the state are similar.

You are most likely right. A smaller city that I worked in we couldn't take any arrest action against a city ordinance violation. We had a drug case threw out because the only PC was loud music(violating ordinance) and we had a huge problem when we arrested someone for refusing to sign a city ordinance citation and disorderly conduct. When we went to the prosecutor it was explained that we couldn't arrest for city ordinance violations because of the way our city charter was written and apparently most are written the same way. Our city court judge was appointed and not elected, apparently this makes all the difference in the world(even though the cases were going to a sessions court judge).
