I really think this guy should've used a larger caliber gun, so that sack of crap would be dead. I'm also hoping he isn't treated like he's the bad guy, when he shot that thug for robbing and threatening him.

I might be in the minority here, but it sounds like this guy made a really dumb move. The bad guy was walking away and the good guy gets out of his car to pursue. First he risked getting himself hurt or killed when he should have just driven away and called the cops. Second he risked getting charged with assault or murder by pursuing the guy, essentially creating a new situation after the first situation had ended. The time to pull the gun would have been when he was actually being robbed.

you can't outdraw an already drawn firearm. I'm in agreement with tungsten on this one...

My first thought was "bad shoot." Then I thought it over and came to the conclusion that once the BG turned around, it was a completely new situation. The initial situation had ended when the BG ran away, and a new one began when the BG gave up his attempt to flee and turned around on the victim. In that situation, the victim felt a reasonable fear of loss of life or bodily harm due to the BG having a weapon in his hand. In my mind, that justifies it as a "good shoot." I'd be interested in seeing what happened in this case.

Exactly. New situation, and I'm sorry, but the robbed had now become the aggressor. IF the OP is the correct story, this is not going to go well for our "good guy." Big "if." Have to have all the facts to know for sure.

Good point. When the victim exited the vehicle with his ccw in hand, he was knowingly entering a situation with a armed person. In other words, he basically instigated a gun fight. Had he not had his weapon drawn when the BG turned around, that would have made the scenario different. Hmm...
