Not very PC line of thought

I wish one of our elected politicians would get up and state that its NOT Gun Control we need to be pursuing but Crime Control.  We need to get the guns out of the hands of criminals, including but not limited to gangs and dope dealers.  The mentally ill need to be taken care of even if it means forced institutionalization, sounds harsh but they really don't need to be out and about hurting themselves and others and if their families can't/won't do it then society needs to.  Gun laws can be boiled down to simple laws, 1) everyone has the right to have firearms, whatever they want and can afford,2) use a firearm in a crime and your going away for a LONG MANDATORY time with any accomplices getting 75% of the time, 3) Violent felons or those jailed on drug charges cannot ever own a firearm again, 4) non-violent criminals can have their rights reinstated. 5) Criminals found in possession of a firearm after release from prison will be immediately sent back to prison for once again a LONG MANDATORY period of time.  6) Those judged mentally ill get the same sentences but go to a mental institute instead of a jail.

 

7) Kill anyone with a firearm while committing a crime is a death sentence if criminally insane it is a life sentence with no parole.  Accomplices get minimum of 50 years.

 

Real simple laws, straight forward, leaves the law abiding gun owner the frick alone and targets the problem.

1: I agree. Everyone.

 

2: I disagree. This is the same logic as the "Hate crime bill". If you murder someone, you should be tried for that murder. Giving extra time for using a gun is assentially saying that guns are more dangerous than every other way you could kill someone.  

 

3 :I disagree. If they are too dangerous to own a firearm than they should still be in prison. The 2nd amendment does not have an "Except" in it. Ex felons deserve the right to defend themselves. Pay your debit to society, and be done with it.

6: I agree

 

7: I agree sort of. Take the firearm out of the equation and add the possibility of the death penalty to rape I can agree.

Here is my not-PC-compliant rants.  

 

Economy:  I think there should be officially two economies in this country.  Capitalism for those that can make and communism for those that cannot.  Communism replaces welfare.  Communism shouldn't even have money just vouchers for your allocation of basic stuff needed to survive.  Communism here should be the same standard of living that it enjoys in Cuba and other parts of the world.  It should really make one want to get back into capitalism.  Everyone that is able should work or be in training for a new job.  This is where the government should get it's manual labor workforce.  No cable, no car, no phone, no fast food, no air-conditioning, .....  If you can find a job (second job) you can work yourself out of communism.

 

Law Enforcement:  Misdemeanors should be punished financially.  Fine them heavily.  If they can't pay, then they have all assets forfeited and they are now in the communist system as described above.  Felons should also be fined but also have a more severe punishment.  Felons should lose all recourse to the law (yes just like Pink Floyd said).  The constitution, bill of rights, and all laws of our society no longer protect you.  Whatever happens to you is not a crime.  If the family of your victim(s) want revenge you have no recourse.  I think after a couple of killings on the courthouse steps people would get the message not to be a felon.

I would just like to see the laws on the books enforced.  Too many liberal judges and attorneys.

And serve the sentence in full. No more "Country Club" jails. I keep hearing that it cost TN more than 30k per year to house a prisoner. That needs to be stopped! Half that would be closer to a realistic amount.

I'd like to see about two third of the laws on the books nullified. Our system has become too complex

and corrupt by it's size, alone.

 

Putting two very different political ideologies next to each other in the same government is much too

dangerous, and is similar to the Democrat vs. Republican battle we see each election cycle, but would

be a more dangerous thing to have in bed with each other. One would always try to takeover the other,

like our current bout with a certain political party injecting communism, already. I think I know what you

meant, though.

I would do everything I could to get rid of the asset forfeiture and property seizure laws, completely. Even for RICO

statute crimes. That's too much power that is concentrated in one place that is a violation of the Constitution. It

is an infringement of anything concerning property rights, much less private property rights. It undoes a lot of the

Bill of Rights.

 

Otherwise, pretty good list of non-PC rants. :D

2) Disagree; as someone stated earlier, murder is murder.  The means used to carry it out shouldn't make any difference.

3) Disagree.  If someone gets jailed for a personal use level of any drug they should not lose their right to own a firearm. No, I do not use drugs, no ever have.

4) Disagree from the standpoint that not all nonviolent criminals should lose their right to own a firearm.

5) Disagree.  It depends on the type of crime that they were incarcerated for.

7) Disagree.  Kill someone with anything while committing a crime.  Firearms should not receive special treatment.

 

I disagree with most of what you stated.  It is way too authoritarian for my taste, and creates special provisions regarding firearms that shouldn't exist.  I absolutely do not agree with creating new laws or regulations regarding firearms; that is the last thing we should want.  Enforce the existing laws that make sense, are effective, and reduce crime.  Scrap the rest.

nra37922, overall I like the way your thinking but have a few comments.

 

Your number 3 seems to violate your number 1.

 

Instead of using the word firearm in number 2, change it to weapon. It riles me that in TN it's armed robbery if you use a gun but any other weapon makes it aggravated instead of armed. It should be considered an armed crime whenever they have any weapon with them and the punishment should be equal. Also, the weapon should only need to be present to make the charge. Carry a baseball bat while robbing a convenience store and get charged with armed robbery. In plea bargains, felonies should not be reduced to misdemeanors.

 

As for number 7, Indiana passed a law a few years ago that would work well. They replaced the not guilty by reason of insanity plea with a plea of guilty but insane. If convicted you go to a mental health facility for your sentence. If you're able to be released from that facility you go to prison to serve the remainder of your sentence. As an example, you claim insanity, are convicted and get 30 years for armed robbery. You go to a state mental hospital and in 12 years they deem you able to return to society. You then go to prison for the remaining 18 years of your sentence.

KISS laws that are effective and work.  I am SO FRIKIN sick of bills that run 200+ papers of gobbledygook and BS that my head spins trying to wade through any of them, which is probably the plan anyhow.  The point I was trying to convey with this thread is that it doesn't take a Philadelphia lawyer to come up with crime control laws that are simple and can and will work IF enforced..

Convicted violent and drug offenders shouldn’t have guns; that is pretty much the way it is now; especially in this state where there is no option to restore gun rights to those offenders.

 

The mentally ill shouldn’t have access to guns. That’s kind of a no brainer, but the database or enforcement seems to be a stumbling block. I doubt most seriously mentally ill people have been adjudicated by a court.
