I'm not so sure his rights are being violated since whatever he says during his interrogation can't be used against him in court. His interrogation will not involve anything resembling torture. I bet they get him to crack in a matter of hours without anyone even raising their voice.Help me on this one, since I'm not as learned as some, but how and what rights are being violated by interrogating the individual for intel purposes independent of a criminal investigation?


I agree. Getting a conviction won't be a problem anyway, so they can sacrifice some court testimony right now in order to get info on other possible terrorists. The question will be whether they try to cut him a deal for that info. Edited by Batman

i doubt this guy has much info ~ from what I've seen, he was simply a follower.  Doing what his big bro told him to do .... A pawn, and that's likely it.

 

Well, unless folks seriously think we'll torture him, he doesn't have to say jack, Miranda or not.

Right, but he is the best connection they'll have to solving the puzzle. He may have seemingly limited knowledge, but that limited knowledge can put them on the right track, confirm educated assumptions or reports, or fill in gaps. That, paired with related intel they already have is a whole lot. I have a feeling the unnamed country looking into the older brother is being tapped for everything they got. Expect that your various tier 1 door kicker units will be shooting people in the face in distant lands over the weekend.

19 year old pawn will talk, and it likely won't take long.  Add to that the meds he will be on for pain ~ Investigators may have his whole life story prior to the morning light :) LOL

 

You do bring up good points TMF.  Limited info ~ whether that be communications, where they got $$$, materials, etc.... will still certainly help :)

The overall subject is touchy .... Foreign born, naturalized USA citizen, radicalized .... Its a hairy situation any which way you look at it.

 

As much as I hate to say it, there is a Code of Ethics, and the Miranda warning does serve a purpose.  I've never been on a battle field ~ but respect each and every one's opinion on the subject :)

 

Justice has & will be served ~~ whether we agree on the outcome or punishment might be another subject all together :)

Say he doesn't crack right away. Say they need to continue the interrogation. They aren't going to use any of this in the trial so it is ok if they have to hold and question him incommunicado without access to an attorney for a day, right? What about a week? What about a month? A year? Five years? How long until we are violating his civil rights? No matter how much it pains us, he is a US citizen and needs to be treated as such. 

 

They are setting precedents here that will apply to all of us. So when they decide that some of us who value our natural rights and civil liberties are the real enemies, what happens with this shitbag, will happen again to you.

There are a couple of issues here. One being that Miranda only protects a defendant against his own words being used to prosecute him without waiving his/her rights. They have all the evidence they need to prosecute and they are still gathering it. Any words he says without being questioned wil be used against him. The Supreme Court says in today's age any reasonable, mentally competent adult knows spontaneous statements to police are incriminating.

They should just question him all they want. Miranda warning is so over thought, half the time I don't care what try have to say, so I don't read them. Normally it is detectives that want to question not patrols making arrest for crimes we saw happen. Edited by Patton

I understand the sentiment here, and however this goes will be what sets the precedent. I believe in the preservation of his rights, not for the sake of him, of course. It's just that I'm not educated enough on the subject to understand at what point a person has a right to an attorney if there is no exchange with the suspect relating to the criminal case. It seems moot since he could admit to anything and everything during an interrogation and it will have no bearing on his trial.

That doesn't sound to me as if his rights are being violated. No different than if a judge orders to have him held without bail... that happens all the time. Seems the only difference here is that the suspect has a golden ticket to say whatever he likes without it affecting him criminally. At any rate, it will be a while before that happens since he won't be interrogated until being discharged from the hospital.

I would really like an attorney to chime in with their opinion on the matter, and what the precedent set by this will mean for future cases such as this.

I would guess the interrogations will begin as soon as a Doctor clears the cops to talk to him. That is what I have seen when a suspect is hospitalized.

Probably not with this case. They are going to need a controlled environment with the guy on no pain meds. This isn't the type of interrogation you do bedside. They may try question him to some degree to determine of there are any imminent threats, such as another cell, but it's probably safe to say that he has no knowledge of that due to the structure of these organizations and where he sits on the totem as an expendable. The main show will occur in a controlled environment. It ain't like he's some druggie who did a drive by.

That's not what I mean about "controlled environment". I don't doubt that is one of the most secure places in the country right now.

If they would have wore wigs and facial hair with new clothes they would have gotten away. Even I would have known the FBI would gather all video and pics from that race.

They sent all that time planning and failed to hide thier real faces. Good thing all these bombers dont have a real smart mind.

I think the bombers had planned to keep bombing/shooting/fighting/etc until they were killed, therefore they didn't bother taking precautions like wearing disguises or having an escape planned out.

I don't believe that they had planned to be captured alive either, which hopefully will work in our favor, if they can get any useful intel out of the 19 year old before his attorney is able to step in & shut him up.

Guess we will find out ...
