Perfectly legal. If you are in fearful that the dog may injure you or your dog, yes, you can shoot. Whether the owner is there or not has no bearing on the legality.

The article I read yesterday said that "Milo" had left bloody puncture wounds in at least one of the leashed dogs. If any dog, no matter its size, makes one of my dogs bleed, it will be shot or severely injured by way of my foot. The method will only depend on the dog and the situation.

exactly, you wouldn't think a boston terrier was big enough to do anything, but one of my neighbors growing up had one and it took a huge chuck out of his calf by theirs.  I love dogs but would have no trouble putting one down if need be.

I don't care how small or harmless something appears if it can break the skin and is aggressive I will protect myself. Now I may have to use a boot or I might have to shoot it but in either case I would hope I am in the right. There are several reasons to prevent any animal, no matter how small, from biting you. Rabies is a very serious disease and even the precautionary treatment for infection isn't exactly fun. Then there are the bacterial infections that can happen.

 

Last year I was infected by a cat bite (our cat) and it was very painful as it had infected the tendons in my right hand. Doctor said if the antibiotics didn't help in 24 hours he was scheduling surgery because the infections spread really fast through the tendons. The night of the bite it felt like I had a serious burn under the skin. I did not sleep at all, or at least not much, from the pain.

It didn't say if there were any marks on Milo, hum, thought not... If a dog (which is violating the leash law) attacks my dog who is on a leash as they legally should be when out in the neighborhood...  I am gonna hurt the dog....  then the owner is gonna have some "explaining" to do to law enforcement.  Last time I looked we were required to control our animals or animal control will do it for us...

I believe leash laws are on a city by city basis, but I'm fairly certain most cities have such laws on the books.

Yeah, I can't stand those yuppies.  This line especially burns me up... "Pet owners in the area say they'll be extra careful from now on, not knowing whose dog may be next."

 

WTF, it's not like this guy goes around shooting dogs.

Ok, yes I agree the shooter was within his rights, and yes I have no problem putting a vicious dog down, but really. Milo looked half dead already. I would hope I could get his broke down butt off my dog. I wasn't there, but this may be a little excessive. Poor old Milo.

Even though legal, would there not be some paper work for discharging a firearm within Nashville city limits? Or is that exempt when legally defending one's self?

You reach your damn hand in there in the mess of gnashing teeth. I'd defend my dog just the way this guy did since the owner couldn't get it under control. Moving to E Nashville next week, they'll just have to get used to me carrying.

As much as I love my dogs, if one of them were attacking someone else's dog(s), I wouldn't blame them for shooting it. I know I'd do the same.

There is a state-wide TN leash law.

Find that one for me. The last I checked you where required to maintain control of your animal no leash mentioned.

If a dog attacked my dog while we were walking, I would most definitely shoot the attacking dog.

Nobody has mentioned this part of the story.

 

 

According to the police report, the man told Milo's owner that if Milo would not stop attacking his dogs, he would have to shoot it. The man told police that's when Milo's owner to him to "do it."

 

That sounds like the owner couldn't get Milo under control.

 

The claim that Milo's owner said "do it" makes the neighbors comment odd. "Pet owners in the area say they'll be extra careful from now on, not knowing whose dog may be next." How about being careful because your pets deserve nothing less? Don't let them run loose, protect them or give them up. I don't understand people that let their dogs run in the street and then wail and scream when they get hit by a car. What do they think is going to happen? They're not only endangering their pets, they endager everyone driving down the road.

 

I feel bad for the shooter. If he's a dog lover he probably feels terrible about what he had to do, but I think he was given no choice.

Yeah, I think a swift kick to launch the dog across the alley would have taken care of it.  Most dogs will remember that.  The dog has probably been coddled all its life.

That is why i carry a beating stick when i walk my dogs. I have been approached by much larger dogs not on a leash. 1 to 2 good thumps on the head does it about every time. I also wouldn't keep a dog that attacked other dogs for no reason.
