County 2nd Amendment Resolutions

Madison County was the first of Tennessee Counties to pass a 2nd and 10th Amendment supportive Resolution.  (reproduced in full below)  It is  my understanding that McNairy County, which arguably has the most 2nd Amendment supportive Sheriff in the State, tabled their version of this same Resolution.

 

Whereas, the Second Amendment to the Constitution of the United States reads as follows, “A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed,” and

 

Whereas, all federal acts, laws, orders, rules or regulations regarding firearms are a violation of the Second Amendment, and

 

Whereas, the Madison County Board of Commissioners declares that all federal acts, laws, orders, rules, regulations – past, present or future – in violation of the Second Amendment to the Constitution of the United States are not authorized by the Constitution of the United States and violate its true meaning and intent as given by the Founders and Ratifiers; and are hereby declared to be invalid in this county, shall not be recognized by this county, are specifically rejected by this county, and shall be considered null and void and of no effect in this county, and

 

Whereas, the State of Tennessee has the power given to it by the Tenth Amendment of the Constitution of the United States and the duty to protect its citizens and prevent infringement of any unconstitutional federal acts, laws, executive orders, rules or regulations, and

 

Whereas, we believe it is the duty of the Sheriff of each County in Tennessee to take all measures as may be necessary to prevent the enforcement of any federal acts, laws, orders, rules, or regulations in violation of the Second Amendment to the Constitution of the United States, and

 

Now, therefore be it resolved that the Madison County Board of Commissioners hereby supports and request the legislature of the State of Tennessee adopt and enact any and all measures as may be necessary to reject and nullify the enforcement of any federal acts, laws, executive orders, rules or regulations in violation of the Second Amendment of the Constitution of the United States and of the Constitution of the State of Tennessee.

 

Be it further resolved, that we call upon the State of Tennessee to adopt and enact any and all measures which would clarify the Sheriff’s duty and responsibility to defend the citizens of the State of Tennessee against infringement by the federal government.   Furthermore, we hereby ask the Sheriffs of the State of Tennessee to act on behalf of the citizens to defend them against infringements upon their rights and to hold the federal government to the limitations provided under the Constitution.

 

Be it further resolved that this body directs the office of the County Executive/Mayor to provide a copy of this resolution to all Tennessee counties and requests the Legislature to join in passing this resolution and forwarding it to their state delegations.

 

From attendees who watched this laid on the table unanimously, there was no public comment allowed, it is being bandied about that the commissioners are concerned about the Sheriff having too much power if said Resolution is passed, along with the statement that the TN State's Attorney General has declared the resolution "Unconstitutional". 

 

Shades of Brian Kelsey, Doug Overby, John Stevens and Lowe Finney.  We are getting as bad as Colorado and our US legislature.
