Has Zimmerman Waived His Right to a Pre-Trial "Stand-Your-Ground" Hearing?

Any way this turns out, something will be wrong with the decision. A good thing about an all woman jury, with the

possibility of an hispanic is that the Federales' head will explode trying to get Zimmerman on some trumped up

federal charge if the blacks don't like the verdict. They will try.

  Sad?  Really DAVES; REALLY???

I'm confused; where does this concern about Zimmerman getting a fair trial come from? I ask because it seems to be in complete contradiction to what you posted just a few days ago when you said this...

...I personally hope Zman gets off the hook. I also hope he gets sued for millions for "wrongful death" and the dude (cowboy) cop wanna be, will never get to live a normal life. There are "hits' on him and he will always be looking over his shoulder and watching the shadows for the rest of his life. The jury can render a verdict of "innocent" and he'll pay for his stupidity for the rest of his life (how ever long that will last).

Just a few days ago you've stopped just short of saying that you hoped Zimmerman would be murdered, you know...those "hits"...and now you feign concern about whether he'll get a fair trial???   is this desire for a fair trial based on your belief that, despite your many, many statements to the contrary, you know Zimmerman is actually not guilty and you are concerned that if he gets a fair trial he'll be found not guilty meaning your desire, quoted above, will come true?

Zimmerman Trial Day 1:  Opening Statements & Theories of the Case

Hey folks,

Today marks the first day of the trial proper, with opening statements.  It is with these statements that both the State and the defense will set out their theory of the case.  We will, of course, be covering today's trial with all-day live coverage, including video streaming and a running Twitter feed of selected commenters, here:  Legal Insurrection Zimmerman Trial LIVE - Day 1 - Opening Statements.

To date, the State's apparent theory has been that Zimmerman "profiled, chased, and killed Martin."

The theory of the defense, in addition to challenging the underlying criminality  of Zimmerman's alleged "profiling" and "chasing," is that Zimmerman's killing of Martin was done in necessary and lawful self-defense, as provided under Florida law.

It should be fascinating to see what "facts" the State points to in both supporting the alleged criminal charge (which the State will have to prove beyond a reasonable doubt) and in undermining Zimmerman's claim of self-defense (which the State will have to disprove beyond a reasonable doubt).

P.S.  FYI, we've pulled together a compilation of our notes on these six final jurors (and the four alternates) here: Meet the Zimmerman Trial Jurors.

Why don't you cut him some slack? I think DaveS realizes, whatever his opinion may be, that there will not be any

justice served, even if it doesn't go the way he thinks it should. You know good and well he and I disagree on this,

yet he understands that. Justice is a well served plate of horse manure when the politically charged media is involved.

Justice and public opinion often diverge at the wrong time, with the wrong information, with the race baiters and

political interests picking the fight.

West is crushing it.

He got off to a bad start with the "knock-knock" joke, but the defense has been putting a beating on the State ever since.

And it seems the State didn't arm itself in preparation.

I watched (well, more listened than watched) until the lunch break...I agree, the joke didn't go over well although I do think it was a tiny bit funny. Other than that I think he's been doing a good job.

Frankly, unless this jury is just out to get Zimmerman I don't see how they will ever reach a unanimous decision of guilty of either murder2 or manslaughter.

You sure waited a while to go there.

I'm purposely ignoring DAVES at this point...nevertheless, I think what he claimed was his ultimate "hope" for Zimmerman was, at best, damn irresponsible.

No, I've been working a gun show and haven't given this topic much time of day. However, we are individuals and can

disagree, can't we?

Refer to post 108 you made on how to "ignore" folks....

Don't be ridiculous! Of course not.

I'm just saying that all things being equal, a woman might be more likely to find an emotional connection that the prosecution may try to capitalize on.

Jeez, lighten up, Francis.

I'd be happy to, Francis, but I don't think I'm the one or at least not the only one who needs to lighten up...the ;) is usually a pretty good indicator that the person was joking.

Again ROBERT< you throw my name in....ATTACK ATTACK!!!!! GET OFF MY BACK!!!!!

Are you serious? When you voice your opinion, you should probably expect a possible debate. If you aren't up for the debate, you can always choose to leave the thread...for the umteenth time. I'm sure there are other forums that are more pro-Martin friendly, and they'll probably stroke your opinion until you're all warm and fuzzy inside.

Many of us have found ourselves on the unpopular side of debate, so you're hardly the only one.

So who else is watching the streaming video of the trial.  So far i think the defense has had a much better opening argument.

I am. And I agree that the defense is presenting a much better case.

They've hit everything I thought they needed to on cross and rebuttal, and I think the: "Feelings based opening statement" was lame compared to the "Let me walk you through all the facts" based OS.   Despite the lame joke and boring potential.

Pre-emptively dismantling the Prosecution's "evidence" could be a wise strategy.

I found the "TM's Dad said something rude to a member of GZ's "party"" particularly interesting.

And what is with Crump being on the witness list *AND* being present in the courtroom?

Zimmerman Trial-- Day 1 Wrap-Up:  Opening Statements

Hey folks,

I just posted up the wrap-up for day 1 of the Zimmerman Trial. I just cover the opening statements in this wrap-up, including video of the actual statements, as well as my analysis.  The State also moved through it's first four (well, 3.5) witnesses later in the afternoon, but I'll cover those in a separate post.

(Note--this post includes both my mid-day analysis, which you might already have read--but I added lots of video, pics, and tweets to the original--as well as the remainder of West's opening after the lunch recess.)

I know much of the mainstream media loved the State's dramatic half-hour opening, and disliked West's lengthy opening and his rather flat delivery (as well as his admittedly lame joke), but in terms of substance West was clearly the dominant player today.  His opening may not make for great television news video clips, but he banged on the actual facts in evidence for two hours, whereas the State's minimal opening statement was almost entirely fact free (and many of the "facts" they did cite were either favorable to the defense--such as the sharp spike in recent crime in the neighborhood--or clearly irrelevant to guilt--such as the fact that Zimmerman's gun was properly loaded to capacity.

In any case, if you'd like to read it you can find it here:   Zimmerman Trial Day One – Analysis of Opening Statements

We'll do it all again tomorrow, of course, starting at 8:30AM rather than the usual 9AM.

Best,

Andrew

Love the updates, has the relevant info and i don't have to check throughout the day from the usual news sources.

One question for you, do you think the state is going to focus on the emotional aspect and try to get a verdict based on that instead of evidence?  It didn't seem from your update that they really had any substantive purpose during the opening statement.
